Fernãoan Constitution Act

An Act of the Senate to make provision for the establishment of the Fernãoan Constitution, and all that entails.

BE IT THEREFORE ENACTED by the Head of the State, by and with the counsel of the Government, and the authority of the Senate by virtue of the powers placed upon it by the Law, as follows:


§1 – Structure and Formulation of the Constitution:
  1. Establishes the name of the constitution for the formal government of Fernão to be the 'Constitution' and the 'Fernãoan Constitution,' to be used interchangeably.
  2. Mandates that the Constitution be comprised of a Preamble, Bill of Rights, Articles and their Sections, Signatures of all Present Senators and Provisional President, and Amendments, in that order.
  3. Further Mandates that the bill that shall pass through the Provisional Government and be defined as the Draft Constitution be immune from motions and actions for indefinite tabling, removal from consideration, filibuster or cloture, unless otherwise permitted by the Interim Speaker.
  4. Forbids the usage of any Committee to be used in the drafting or passage of the Draft Constitution, rather the process be open to the entire Senate.
  5. Orders the fact that any proposed amendments to the Draft Constitution, as it is to be known, be in the form of a clause or multiple clauses, and votes to include them be through a simple majority as a division of the question.

§2 – Legal Prerequisites:
  1. Requires that a judicial review by the entirety of the High Court be called, with a maximum duration of 7 days, to assure the legality of the Draft Constitution once it has been approved by the Provisional President.
  2. Establishes the right of the Constitution to be the supreme law of Fernão and its citizens, superseding all other legislations, court mandates, executive actions, Senate motions, etc.
  3. Would be sensible to add that the High Court functions as the interpreter of the Constitution, like how Supreme/High Courts work in other nations.

Would be sensible to add that the High Court functions as the interpreter of the Constitution.

That would go in the Constitution, not the Act established how said Constitution should be made (which this one is). Though yes, the High Court should indeed be the interpreter.
Section 2, Clause A already makes judicial review a requirement, anyways. The High Court is being used.

National Time Zone Act

BE IT THEREFORE ENACTED by the Head of the State, by and with the counsel of the Government, and the authority of the Senate by virtue of the powers placed upon it by the Law, as follows:


§1 – The FST:
  1. Establishes the name of the time zone of which all of Fernão and its constituencies be a part of be Fernão Standard Time, or FST.
  2. Mandates that FST be Coordinated Universal Time (UTC) +4 in its time setting, equivalent to Gulf Standard Time (GST).
  3. Further Mandates that Coordinated Universal Time be the standard time in which FST be based off of.
  4. Further Establishes that Fernão shall not observe Daylight Savings Time.

The only thing I can see wrong is clause e, which has nothing in it, which is just an error I'm assuming.
Once that's fixed up, I sponsor.

Also, I'm working on a bill establishing grammatical standards to be applied to all future legislation. It's going to mandate the standard conventions of British English, along with other things like usage of the Oxford comma, forbid double negatives, and discourage usage of contractions.

Any grammar nazis want to suggest other standards to shove down people's throats? :p

Recognised country- A country which the government of Fernão officially views as being its own sovereign entity with a valid claim over the land it governs over
Territorial dispute- A situation in which two or more countries disagree over the ownership of a particular area


Section 2: Recognised Countries
The following states are hereby officially recognised
a. All member states of the United Nations
b. Kosovo
c. Palestine
d. Vatican City
e. Western Sahara

Section 3: Territorial Disputes
a. Fernão will officially recognise the land claims of the previously mentioned nations without UN recognition
b. Unless otherwise specified, Fernão will take the position held by the United Nations in territorial disputes, and remain neutral in conflicts which the UN has no official position

I still think that Somaliland should also be recognized, but the list is good right now. That being said, it might be better to call Western Sahara the Sahrawi Arab Democratic Republic, since that's the official name.

As it stands, I would prefer not to recognize any foreign entity that would immediate earn us enemies. Kosovo and Palestine does that.

An act to establish which foreign entities Fernão should give official recognition as sovereign nations

Section 1: Definitions

b. Unless otherwise specified, Fernão will take the position held by the United Nations in territorial disputes, and remain neutral in conflicts which the UN has no official position


Atlantica, thanks for pointing that out. In its current form, would you be willing to sponsor?

And to Ferak, we have more enemies to make by not recognising Palestine. Basically all of our neighbours recognise Palestine. As far as Kosovo is concerned, emotions don't run as high for most of the world in that dispute, so really only Serbia would be really pissed, maybe Russia just very slightly displeased.

  3. Further Mandates that the bill that shall pass through the Provisional Government and be defined as the Draft Constitution be immune from motions and actions for indefinite tabling, removal from consideration, filibuster or cloture, unless otherwise permitted by the Interim Speaker.
  4. Forbids the usage of any Committee to be used in the drafting or passage of the Draft Constitution, rather the process be open to the entire Senate.
  5. Orders the fact that any proposed amendments to the Draft Constitution, as it is to be known, be in the form of a clause or multiple clauses, and votes to include them be through a simple majority as a division of the question.

§2 – Legal Prerequisites:
  1. Requires that a judicial review by the entirety of the High Court be called, with a maximum duration of 7 days, to assure the legality of the Draft Constitution once it has been approved by the Provisional President.
  2. Establishes the right of the Constitution to be the supreme law of Fernão and its citizens, superseding all other legislations, court mandates, executive actions, Senate motions, etc.
  3. Further requires the Constitution to include a clause that specifically mandates that the formal Government of Fernão and its associates be explicitly prohibited from engaging in any activity that violates the provisions listed within the UN Human Rights and all its Protocols, the UN Convention on the Rights of the Child and all its Protocols and the UN Geneva Convention and all its Protocols.


National Time Zone Act

An Act of the Senate to make provision for the establishment of the Fernãoan Standard Time Zone, or FST, and all that entails.

BE IT THEREFORE ENACTED by the Head of the State, by and with the counsel of the Government, and the authority of the Senate by virtue of the powers placed upon it by the Law, as follows:


§1 – The FST:
  1. Establishes the name of the time zone of which all of Fernão and its constituencies be a part of be Fernão Standard Time, or FST.
  2. Mandates that FST be Coordinated Universal Time (UTC) +4 in its time setting, equivalent to Gulf Standard Time (GST).
  3. Further Mandates that Coordinated Universal Time be the standard time in which FST be based off of.
  4. Further Establishes that Fernão shall not observe Daylight Savings Time.
