LGBT+ Rights Survey (CLOSED)

Postby The Norden Utopia » Sun Jun 23, 2019 8:17 pm

Introduction

The LGBT+ Rights Survey is a method of avaliating nations human rights, equality and opportunity related to the LGBT+ population. The Survey uses the same parameters as the Rainbow Europe LGBT+ Rights Survey (click on it to go to Rainbow Europe website). The only difference is that this Survey was adapted in form of a questionnaire in order to avaliate nations answering it. The questions were based of The Arthurian Isles (Check his Survey here)
However, there are none active LGBT+ Rights Survey currently, so the government of The Norden Utopia decided to remake the questionnaire, adding new questions about more current topics. Each question has a value attached to it. The index varies from 0 (blatant LGBT+ human rights violations) to 10 (full protection of LGBT+ human rights). There are 6 categories used to measure the final index, and they are: Equality & Non-discrimination, Family, Hate Crime and Hate Speech, Legal Gender Recognition and Bodily Integrity, Civil Society Space and Asylum

We recommend that you read the FAQ section (below the post) before applying. Any questions not on the FAQ may be sent directly in the forum or by telegram

Frequently Asked Questions

Are these questions repeated? Do I have to fill it out again?
No, they are not repeated. There are differences between sexual orientation, gender identity and sexual characteristics. Sexual orientation refers to the object of one's affection, specifically concerning that object's biological sex, gender identity, combination of the two or lack thereof. Gender identity refers to the subject's conception of their own gender, sometimes regardless of their biological sex. Sexual characteristics are the physical features one is biologically born within. To make it easier, I separated it into sections.

The Survey is very long. Do I need to complete it entirely?
You need to at least answer with a yes or no. But, be aware that the more complete are your answers, the most accurate the score will be.

May I change my answers?
Yes. To change your previous answers please post a new message which either (1) mentions the changes which have been made, or (2) includes a new form filled out in full with the revised answers. The new results will then be included in the subsequent set of rankings.

I dont like my rank. Can you change it?
No. The scores are determined by pure maths, and, consequently, unchangeable.

Why do I lose points for not having laws against hate speech even though this means that I have free speech which is a moral good?
The Survey is overall directed to LGBT+ rights and freedoms, not general freedoms.

You are not posting new rankings for quite a while. Is the Survey closed?
No. The Survey will only close when the title says so. I'm a human with a life and this means I also have obligations. If I'm not refreshing the rankings it's either because I'm busy, or because I'm waiting for more results to come in.

Equality & Non-discrimination

Sexual Orientation

Does your constituition (or equivalent) includes provisions banning or limiting discrimination based on sexual orientation? Yes. Including both men and women based discriminatory actions.
Does your country have employment laws that prevent discrimination based of sexual orientation? Yes and no. Private businesses have legal protections on who they can hire. Public sector (government jobs for example) do not.
Does your country have laws allowing anyone to purchase goods and services regardless of sexual orientation? Yes. But as noted above, private businesses have the right to deny service on applicable grounds - sex not being one of them with extreme exceptions (jobs where men are required, such as fireman, or where natural differences in sex can be applied). Private business is protected against frivolous orientation claims (such as forcing cake makers to make gay wedding cakes even if against their wishes/beliefs).
Does your country have laws allowing anyone to have a proper education regardless of sexual orientation? Yes. Education is a right for all citizens - private or public institution.
Does your country have laws allowing anyone to have a proper healthcare regardless of sexual orientation? Yes and no. Healthcare is deemed a good, not a right. But in that same fashion, it is illegal to deny service to those with emergency situations. Thus sex or sexual orientation matters not.
Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all sexual orientations , or is it systematically working on this regardless of a mandate? The Ministry of Justice oversees all rights, justice, protections issues. It's guidelines for human rights steers close to civil rights for the Empire and thus probably differs greatly from other nation's definition of "human rights." The Empire fights for the rights of its people, though as you'll see later on, not everyone agrees on what's a right or isn't internationally.
Does your government operate an active policy of improving human rights, protection and equality explicitly to all sexual orientation? No. It doesn't view such perimeters when exerting its influence, only that its citizens and their rights are protected. So technically yes, but indirectly so.

Gender Identity

Does your constituition (or equivalent) includes provisions banning or limiting discrimination based on gender identity? Yes. Gender has as of 2016 been revoked in textbooks and government resources in exchange for "sex." Thusly, gender related topics, such as "gender identity", are viewed under the disphoria mental disorder or are amply ignored/refuted.
Does your country have employment laws that prevent discrimination based of gender identity? No. Refer to the first answer as to why.
Does your country have laws allowing anyone to purchase goods and services regardless of gender identity? As stated earlier, gender identity/sexual orientation matters not. However, as also stated, private business is protected in regards to hiring and service practices. To answer the question, the answer is no. Since the government does not recognize gender identity related topics/politics, there is no protections for such people claiming said discrimination, even for government services.
Does your country have laws allowing anyone to have a proper education regardless of gender identity? Much like the previous education answer, all citizens have a right to education, private or public. You will not be given special treatment for such claims, however, unless the private institution follows said requests (such as special bathrooms). To which it may be illegal under certain circumstances regardless if private or public institution.
Does your country have laws allowing anyone to have a proper healthcare regardless of gender identity? See earlier healthcare answer. Additionally, even with surgery related treatments, you will still be recognized by your sex at birth; thus special care may not always be available if requested and may also be illegal or unavailable.
Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all gender identities , or is it systematically working on this regardless of a mandate? The Ministry of Justice, as stated, oversees all rights, justice, protections issues. It does not, however, do this for those deemed to be suffering dysphoria related symptoms. At least not in the way many internationally would deem appropriate. In the worst case, the MOJ actually goes after criminals/suspects related to the field for violations. But just to clarify, it's not an active issue to discriminate against dysphoric citizens, but to eliminate the issues they suffer from and punish those who exasperate the underlining issue.
Does your government operate an active policy of improving human rights, protection and equality explicitly to all gender identities? Yes, just not in the way many internationally see it.

Sex Characteristics

Does your constituition (or equivalent) includes provisions banning or limiting discrimination based on sexual characteristic? See "sexual orientation" section for answer.
Does your country have employment laws that prevent discrimination based of sexual characteristic? See "sexual orientation" section for answer.

Does your country have laws allowing anyone to have a proper education regardless of sexual characteristic? See "sexual orientation" section for answer.

Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all sexual characteristic , or is it systematically working on this regardless of a mandate? See "sexual orientation" section for answer.
Does your government operate an active policy of improving human rights, protection and equality explicitly to all sexual characteristic? See "sexual orientation" section for answer.

Gender Expression

Does your country law holds provisions to guarantee the right of gender expression? Freedom of speech is protected under law. Though not entirely true based on some monarchy related matters, if you wanted to protest on a corner because a cake shop doesn't make gay wedding cakes, you wont legally be thwarted unless you commit a local ordinance violation (such as blocking traffic or harassing customers).

General

May LGBT+ people donate blood (or any kind of bodily tissue) equally as heterossexual people in your nation? You must answer questions, including those that ask if you've had sexual contact with another person in the same sex or if you taken drugs (illegal or not). This is for safety reasons for extra screening. Lying and being caught doing so will result in criminal charges, especially if donated blood harms patients (to which felonies could be attached).

Family

Can same-sex couples marry with the same rights as different-sex couples in your nation? Gay marriage is not legal. Civil Unions instead exist where said participants have the same legal rights as married couples.
Can same-sex couples enter into a civil partnership with the same rights as different-sex couples in your nation? Yes. Civil Unions allow as such.
Can same-sex couples in your country enter into a civil partnership with weaker rights as married different-sex couples? They have the same rights as marriages.
Does your constituition or law limits marriage to a single kind of couple, like man and woman? Yes, as of late 2013.
Can same-sex couples legally apply for joint adoption? Yes.
Can same-sex couples legally apply for second parent adoption? Yes.
Can couples from all sexual orientations, gender identities and sexual characteristics be recognized as the parents of their children after birth or adoption? Those suffering gender dysphoria, a mental disorder, may not. Other similar mental disorders or parents deemed unfit may also not.
Can couples, regardless of sexual orientation and gender identity, receive fertility treatment including artificial insemination? See above for same answer.
Can individuals, regardless of sexual orientation and gender identity, receive fertility treatment including artificial insemination? Same as previous answer.
Can transgender people marry based on their gender identity after their legal gender recognition, thus entering a different-sex marriage? No. It is illegal to falsify government records and marriage/civil union records; doing so could mean fines and even jail time if repeated.
Are transgender parents recognised on birth certificates, documents, etc...? Only as their sex at birth. If they do not hold custody, meaning their gender dysphoria has been deemed too damaging, they will simply not hold custody until determined safe.

Hate Crime and Hate Speech

Sexual Orientation

Is sexual orientation especifically defended in hate crime legislation? Yes.
Is sexual orientation especifically defended in hate speech legislation? No. Freedom of speech unless called to action (such as calling for their murder, etc.).
Is sexual orientation especifically included in government strategies to counter hate crime and hate speech? Yes, at least at the State level.

Gender Identity

Is gender identity especifically defended in hate crime legislation? No.
Is gender identity especifically defended in hate speech legislation? No.
Is gender identity especifically included in government strategies to counter hate crime and hate speech? No.

Intersex

Is intersex status especifically defended in hate crime legislation? Yes.
Is intersex status especifically included in government strategies to counter hate crime and hate speech? No.

Legal Gender Recognition & Bodily Integrity

(Please note: if 'no' is answered for the first question, all further answers will be invalidated. This section refers to a person's ability to alter their gender in line with their gender identity; it does not concern their freedom to alter their biological sex.)

Is there a legal procedure for recognising a person's gender based on their own gender identity? No. Though I will still answer the following questions because it is not illegal to change sex, it is just not legally recognized.
Are there administrative procedures to change a person's gender based on their own gender identity, such as on official documents? If you mean to legally change the sex, such as on a birth certificate, than no. That is illegal. If you mean to physically have a sex change, it is not illegal to do so. It is just not legally recognized.
Can someone of any age change their name without barriers? No.
Is legal gender recognition based exclusively on the expressed will of the person concerned (without intervention of medical experts, judges, etc...)? No.
Is a Gender Identity Disorder diagnosis required in order to a person change their gender? The diagnosis of gender dysphoria/similar disorders is actually the point where said person is required to seek help, especially if deemed a danger to themselves and/or others.
Is non-surgical medical intervention required for a person's gender to be legally changed? No. Sex cannot be changed, legally or by medical means.
Is surgical intervention required for a person's gender to be legally changed? No. See above.
Is sterilisation or proof of infertility required for a person's gender to be changed? No. See above.
Is divorce or single status required for a person's gender to be legally changed? No. See above.
Is there an explicit age restriction before a person's gender can be legally changed? You must be an adult (18yrs of age) to have a sex change operation. As stated you will still be legally recognized as you sex at birth.
Can intersex minors receive non-necessary medical or surgical intervention before they reach the age of informed consent? Only after receiving both parents' approval.
Are trans identities considered a mental health disorder in national clinics (or equivalent)? Yes.
Is Trans-Specific Healthcare acessible to anyone without needing GID or GIC (Gender Incongruence in Childhood) diagnosis? Yes.

Civil Society Space

Can LGBT+ people assemble freely without obstruction from government or nonstate groups? No. Although most wont interfere, the general public outside of few bastions have disagreeing views on gender related topics. Legally, as stated, there is no crime without violating local laws.
Are LGBT+ demonstrations and events adequately protected? Yes and no. It is on them to seek private means, but as with any citizen, they are entitled to proper police protection. Although sometimes this is against their interests (gender dysphoric persons essentially).
Are there any laws that prevent LGBT+ rights associations (NGO's or similar organizations) from acting? Only laws that protect from harm done to others via indoctrination, incitment, and encouragement to break the law (such as encouraging youths to get surgeries using fake means, or abating gender dysphoric/susceptible individuals into developing the disorder).
Are there any laws that prevent LGBT+ rights associations (NGO's or similar organizations) from receiving funds? See above. A punishment may include fines or cutting off legal funding.
Are LGBT+ human rights defenders arrested, harassed or harmed in your nation? Can they do their work without interference from the State? They are harassed quite often if advocating for the dispersal of the disorder. In the most extreme cases, some are harmed.
Are there laws limiting freedom of expression of LGBT+ rights activists and organizations (anti-gay propaganda, censorship laws)? The only thing that comes to mind outside what was mentioned essentially above at some point are pride rallies being almost non-existent. Most towns/cities wont tolerate it either on a fundamental principle or use it as an excuse to not block multiple lanes of traffic on an otherwise busy day. Not legal in some cases, but in others it is. This is because the LGB in LGBT+ don't caucus with the T+ side. The LGB side doesn't agree or view themselves as the same on the grounds they're not suffering a disorder. On the other hand the T+ see it as "non-straights/normal (aka cis genders)" being united by any means. So for fundamental reasons and fears of legal reasons, the LGB side despises the T+ while the T+ side views such actions as gender traitors etc.. Thus even in their own communities such demonstrations are tiny and LGB crowds have little reason to protest/demonstrate often.

Asylum

Sexual Orientation

Is persecution because of sexual orientation a qualifiable cause for asylum request in your country? No. Immigration matters are tightly enforced, and that includes skills based immigration. Asylum requires that said individual(s) identify well with Commoner interests, which can be difficult as most that do are already easily able to immigrate if they go through the procedure.
Is sexual orientation especifically included in positive government policy or instructions promoting asylum? No.

Gender Identity

Is persecution because of gender identity a qualifiable cause for asylum request in your country? No.
Is gender identity especifically included in positive government policy or instructions promoting asylum? No. And just to state for the record, those looking to leave for asylum reasons, which is typically laughed at due to relative safety and prosperous lives regardless if most factors, are not prevented in any way. If such a person wished to leave TECT to another nation that fit their identity views, they're free to leave. But expect returning to be difficult.

Intersex

Is persecution because of intersex status a qualifiable cause for asylum request in your country? No. It is simply not specifically listed as such due to non-importance or overlapping text.
Is intersex status especifically included in positive government policy or instructions promoting asylum? See above.

This took a while so I may have varied in answers than I meant to for my nation, but if you got concerns or questions feel free to ask.

They are typically protected or ignored by guards-there are no records of civil abuse by authorities in Ashakad over such matters. Guards are free to join and participate in these events to provide safety and enjoy themselves at the same time. The State has no place in personal lives, or public demonstration, so they are free to do as they please.
Are there laws limiting freedom of expression of LGBT+ rights activists and organizations (anti-gay propaganda, censorship laws)? No.

Asylum

This section is empty because Asylum does not exist in Ashakad. You show up in an Ashakadan city and you can just buy a house.

*It is worthy to note that the Ashakadan Empire is not sexist, gender discriminatory or sexual orientation discriminatory in any way. These issues are simply just not seen in their world. Sexual orientation is a trivial matter in the Ashakadan Empire, and the bounds of binary gender aren't very solid either; most men wear cosmetics and clothing seen in our world as 'feminine' and there are plentiful amounts of people who are non-binary and other genders. It's just a matter of choice and your own free will.

Equality & Non-discrimination

Sexual Orientation

Does your constitution (or equivalent) includes provisions banning or limiting discrimination based on sexual orientation? Nope
Does your country have employment laws that prevent discrimination based of sexual orientation? Only for the (very limited) public sector. The private sector have full freedom on who they wish to hire.
Does your country have laws allowing anyone to purchase goods and services regardless of sexual orientation? Government services are provided for all, what little there is, but in the private sector if the service provider wants to sell you something, they will. If not, they won't. Businesses may discriminate as they wish, but the government will not stand in your way of procuring said services.
Does your country have laws allowing anyone to have a proper education regardless of sexual orientation? There is a complete separation of state and education. If certain schools don't want to admit LGBT folks, they don't have to. If they want to admit them, or specifically cater to them, they are allowed to. It's a free country.
Does your country have laws allowing anyone to have a proper healthcare regardless of sexual orientation? Well, healthcare is private so, see above.
Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all sexual orientations , or is it systematically working on this regardless of a mandate? Doesn't exist.
Does your government operate an active policy of improving human rights, protection and equality explicitly to all sexual orientation? It generally stays out of people's lives, so no. Private organizations deal with that sort of thing.

Gender Identity

Does your constitution (or equivalent) includes provisions banning or limiting discrimination based on gender identity? Nope.
Does your country have employment laws that prevent discrimination based of gender identity? Not in the private sector.
Does your country have laws allowing anyone to purchase goods and services regardless of gender identity? Same as the first section.
Does your country have laws allowing anyone to have a proper education regardless of gender identity? Same as the first section
Does your country have laws allowing anyone to have a proper healthcare regardless of gender identity? Same as the first section.
Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all gender identities , or is it systematically working on this regardless of a mandate? No such (government) institution exists.
Does your government operate an active policy of improving human rights, protection and equality explicitly to all gender identities? Nope.

Sex Characteristics

Does your constituition (or equivalent) includes provisions banning or limiting discrimination based on sexual characteristic? No
Does your country have employment laws that prevent discrimination based of sexual characteristic? Not in the private sector.
Does your country have laws allowing anyone to purchase goods and services regardless of sexual characteristic? Not in the private sector.

Gender Expression

Does your country law holds provisions to guarantee the right of gender expression? There's no law for that.

General

May LGBT+ people donate blood (or any kind of bodily tissue) equally as heterossexual people in your nation? Generally, yeah, but it's not a government-mandated policy.

Family

Can same-sex couples marry with the same rights as different-sex couples in your nation? Yep. Government doesn't regulate marriage whatsoever.
Can same-sex couples enter into a civil partnership with the same rights as different-sex couples in your nation? Yes; see above.
Can same-sex couples in your country enter into a civil partnership with weaker rights as married different-sex couples? What?

Can same-sex couples legally apply for joint adoption? Yes
Can same-sex couples legally apply for second parent adoption? Yes

Can individuals, regardless of sexual orientation and gender identity, receive fertility treatment including artificial insemination? Yes
Can transgender people marry based on their gender identity after their legal gender recognition, thus entering a different-sex marriage? No, because you can't change your sex. The gender/sex you are born with is the one you are for life under Fredonian Law. Regardless, in the context of marriage it doesn't make a difference because the government isn't a part of it.

No.
Are there administrative procedures to change a person's gender based on their own gender identity, such as on official documents?

Is a Gender Identity Disorder diagnosis required in order to a person change their gender?
Is non-surgical medical intervention required for a person's gender to be legally changed?

Are LGBT+ human rights defenders arrested, harassed or harmed in your nation? Can they do their work without interference from the State? Generally, no they aren't harassed. They can do whatever they want so long as they remain within the legal boundaries. Do not commit aggression against other citizens, do not try to silence them, and do not directly intrude upon their lives. Then, there is no problem.
Are there laws limiting freedom of expression of LGBT+ rights activists and organizations (anti-gay propaganda, censorship laws)? No.

I accidentally illegalized sex for all orientations but it'll come around when someone complains about it. I hope someone does, nobody usually complains except for a few group of people and it's getting harder to think of new laws to add.

The mascot is female.

You're telling me people argue about this stuff outside of the country?

There is found to be no sexual orientation or gender identity discrimination in Mezi Mori from non-foreign source. The standard in Mezi Mori treats features that would put a person stand out in other countries as regular and nothing to blink about, and as a human right. There is a mandatory class in a plethora of languages as soon as you enter the country as an immigrant, tourist, asylum, or without documentation that there will be a major shock to you on how different the product of Mezi Mori is to the countryman beyond but including sexual orientation and gender identity. Mezi Mori may be considered outrageously vulgar to the eye to some unprepared people. There is a complete lack of prisons and most likely any harassing offender will receive a stern lecture and forced to sit in a corner after being documented for the offense.

Isn't that a human right violation to document everything or something?

(Please note: if 'no' is answered for the first question, all further answers will be invalidated. This section refers to a person's ability to alter their gender in line with their gender identity; it does not concern their freedom to alter their biological sex.)

Is there a legal procedure for recognising a person's gender based on their own gender identity? Of course.
Are there administrative procedures to change a person's gender based on their own gender identity, such as on official documents? Obviously.
Can someone of any age change their name without barriers? Yes indeed.

Is non-surgical medical intervention required for a person's gender to be legally changed? Nah.
Is surgical intervention required for a person's gender to be legally changed? Nay.
Is sterilisation or proof of infertility required for a person's gender to be changed? Nein.
Is divorce or single status required for a person's gender to be legally changed? Non.
Is there an explicit age restriction before a person's gender can be legally changed? People aged <16 can legally change their gender with their parents' consent.
Can intersex minors receive non-necessary medical or surgical intervention before they reach the age of informed consent? Surely.
Are trans identities considered a mental health disorder in national clinics (or equivalent)? No.
Is Trans-Specific Healthcare accessible to anyone without needing GID or GIC (Gender Incongruence in Childhood) diagnosis? Aye.

(Your initial mistake here is the belief that L, G, and B, have absolutely anything to do with T. I will answer this survey as best I can but you have already made it difficult by conflating science with fantasy.)

Equality & Non-discrimination

Sexual Orientation

Does your constitution (or equivalent) includes provisions banning or limiting discrimination based on sexual orientation? | No. Ephyra's constitution is derived from two concepts, one physical and one abstract. The Anomedic Tablets are the founding legal code of the Freehold by Valaemedes Anogarios Artalos, laying out both the rights and duties of the citizen, elected magistrates, and the social unit as a whole. It is against the Tablets that new laws are considered, and they routinely fail if they do not meet the established concepts. This is not concrete however, and it is not prohibited for a law to be passed that doesn't align with the Tablets. Alongside this are the abstract traditions of the ancestors, a more communal set of values against which laws are also measured.

In neither the Tablets nor the communal understanding of the ancestral traditions are provisions established regarding discrimination based on sexual orientation. Having a preference for the same sex or both or neither is not in and of itself a crime or anything to be brought to court or challenged about. It is the exercise of sexual orientations in specific ways that can cause problems. If a citizen male is to engage in sex with another male, he should not occupy what is known as the 'feminine' or 'receiving' role. To do so can result in major social stigma as an effeminate. However, if the masculine sexual position is maintained, the sex of the partner in the feminine is irrelevant. For women, this problem is evaded altogether as sexual activity between women is not even recognised as sex.

Does your country have employment laws that prevent discrimination based of sexual orientation? | No, but as per the cultural premise outlined above, it's not considered as a factor unless through the exercise of sexuality an individual is known to have taken the dishonourable position.

Does your country have laws allowing anyone to purchase goods and services regardless of sexual orientation? | No, but they aren't necessary for the reasons above.

Does your country have laws allowing anyone to have a proper education regardless of sexual orientation? | No, but they aren't necessary for the reasons above.

Does your country have laws allowing anyone to have a proper healthcare regardless of sexual orientation? | No, but they aren't necessary for the reasons above.

Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all sexual orientations , or is it systematically working on this regardless of a mandate? | There is no human rights institution or equality body in the Senate and Freeborn Landholders of Ephyra.

Does your government operate an active policy of improving human rights, protection and equality explicitly to all sexual orientation? | No, as it is not important or culturally relevant outside of aforementioned conditions.

Gender Identity

Does your constitution (or equivalent) includes provisions banning or limiting discrimination based on gender identity? | No. Ephyra does not recognise anything but the scientific gender binary; male and female. The concept of which is not represented in law or in the Ephyral language as remotely separate from sex. If you are born male, you are male, and the same for female as applicable. There is no gender identity outside of this binary and switching between them is neither scientifically possible nor legally recognisable. The Ephyral word for sex as a denotation is identical to the word for gender, and it is consequentially not possible in the Ephyral language to express a personal identity as the thing you are not. Those who are able to claim that they are the opposite 'gender' or a separate one altogether are treated for their psychological disorder.

Does your country have employment laws that prevent discrimination based of gender identity? | No - gender identity is not valid.

Does your country have laws allowing anyone to purchase goods and services regardless of gender identity? | No - gender identity is not valid.

Does your country have laws allowing anyone to have a proper education regardless of gender identity? | No - gender identity is not valid.

Does your country have laws allowing anyone to have a proper healthcare regardless of gender identity? | No - gender identity is not valid.

Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all gender identities , or is it systematically working on this regardless of a mandate? | N/A.

Does your government operate an active policy of improving human rights, protection and equality explicitly to all gender identities? | No, because the concept of gender identity is not scientific.

Sex Characteristics

Does your constitution (or equivalent) includes provisions banning or limiting discrimination based on sexual characteristic? | No. Men and women are seen as uniquely different and consequentially unequal in certain fields. The Anomedic Tablets and traditions of the ancestors are clear in their denotation of male and female rights and duties, which are not identical.

Does your country have employment laws that prevent discrimination based of sexual characteristic? | No. Women are not allowed to stand for office as a Senator, join the military, or enter government service of higher levels. Certain jobs that require heavy manual labour will also reject applicants for being female. Conversely, jobs recognised as being more feminine will be prioritised for female applicants.

Does your country have laws allowing anyone to purchase goods and services regardless of sexual characteristic? | No laws guarantee this but it is not an issue and therefore irrelevant to lawmaking.

Does your country have laws allowing anyone to have a proper education regardless of sexual characteristic? | No. By cultural norm, girls are educated for less time than boys due to different expected life paths. This is not legally mandated but is the usual.

Does your country have laws allowing anyone to have a proper healthcare regardless of sexual characteristic? | No laws guarantee this but it is not an issue and therefore irrelevant to lawmaking.

Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all sexual characteristic , or is it systematically working on this regardless of a mandate? | N/A

Does your government operate an active policy of improving human rights, protection and equality explicitly to all sexual characteristic? | No.

Gender Expression

Does your country law holds provisions to guarantee the right of gender expression? | No. Men are expected to behave like men and women are expected to behave like women. Deviation is ostracised.

General

May LGBT+ people donate blood (or any kind of bodily tissue) equally as heterosexual people in your nation? | No, due to higher risk of blood and sexual diseases they are banned.

Family

Can same-sex couples marry with the same rights as different-sex couples in your nation? | Absolutely not.

Can same-sex couples enter into a civil partnership with the same rights as different-sex couples in your nation? | No. The closest such institution is concubinage and this is innately inferior to marriage.

Can same-sex couples in your country enter into a civil partnership with weaker rights as married different-sex couples? | Hypothetically yes. Concubinage does not, unlike marriage, mandate the sex of the socially inferior partner becoming the concubine. However, it is severely improper that this secondary partner be a citizen. Citizen men may therefore take a Lykosian, metic, or provincial man as concubine.

Does your constitution or law limits marriage to a single kind of couple, like man and woman? | Marriage may only take place between a man and a woman who possess the right of marriage through citizenship or Lykosian status.

Can same-sex couples legally apply for joint adoption? | Adoption in the sense understood does not take place in Ephyra.

Can same-sex couples legally apply for second parent adoption? | See above.

Can couples from all sexual orientations, gender identities and sexual characteristics be recognized as the parents of their children after birth or adoption? | No. This question is too broad to warrant a more detailed answer.

Can couples, regardless of sexual orientation and gender identity, receive fertility treatment including artificial insemination? | No. Artificial insemination is not practised in the Freehold.

Can individuals, regardless of sexual orientation and gender identity, receive fertility treatment including artificial insemination? | See above.

Can transgender people marry based on their gender identity after their legal gender recognition, thus entering a different-sex marriage? | No. 'Transgender' people are not legally recognised and are treated for gender identity disorder.

Are transgender parents recognised on birth certificates, documents, etc...? | See above.

Hate Crime and Hate Speech

Civil Society Space

Can LGBT+ people assemble freely without obstruction from government or nonstate groups? | If they apply for a permit like anyone else, yes.

Are LGBT+ demonstrations and events adequately protected? | Yes, but not because they are 'LGBT'.

Are there any laws that prevent LGBT+ rights associations (NGO's or similar organizations) from acting? | No, but they will not find public sympathy.

Are there any laws that prevent LGBT+ rights associations (NGO's or similar organizations) from receiving funds? | No, but they won't receive any.

Are LGBT+ human rights defenders arrested, harassed or harmed in your nation? Can they do their work without interference from the State? | If they commit crimes, absolutely they are. Otherwise no.

Are there laws limiting freedom of expression of LGBT+ rights activists and organizations (anti-gay propaganda, censorship laws)? | Yes.

The Senate and Freeborn Landholders of Ephyra wishes to add outside of the questions put forward by this survey the following understandings,

I. Sexual orientation in and of itself is not a cultural ground for ostracism. It is the exercise of sexuality be it hetero, homo, or otherwise which is subject to social judgement.

II. So-called 'gender identity' is completely unsupported by science as anything other than the psychological manifestation of biological sex, as understood by every culture in human history for millennia. We are no different. No hostility is harboured towards those who feel they are psychologically something they are not biologically, but we do not re-write biological fact to cater to the whims of a tiny minority.

Equality & Non-discrimination

Sexual Orientation

Does your constituition (or equivalent) includes provisions banning or limiting discrimination based on sexual orientation? Yes. An amendment to the constitution has been adopted for this purpose. It is federally illegal to discriminate for hiring purposes based on ethnicity, creed, religion, or sexual preference or sexual orientation. This limitation only applies to employer/employee relationships.
Does your country have employment laws that prevent discrimination based of sexual orientation? Yes, see above.
Does your country have laws allowing anyone to purchase goods and services regardless of sexual orientation? The Federal Commodities Act of 2001 makes it illegal to discriminate against a citizen for the purchasing of any commodities.
Does your country have laws allowing anyone to have a proper education regardless of sexual orientation? Yes. The Federal Public School Act of 2001 is still in effect.
Does your country have laws allowing anyone to have a proper healthcare regardless of sexual orientation? Yes. The General Health Act of 2001 is still in effect, and is regulated under an Imperial order, which means only the President has the authority to revoke it.
Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all sexual orientations , or is it systematically working on this regardless of a mandate? This does not exist in Chadtonia, such regulations are exercised by The Federal Council.
Does your government operate an active policy of improving human rights, protection and equality explicitly to all sexual orientation? Yes.

Gender Identity

Does your constitution (or equivalent) includes provisions banning or limiting discrimination based on gender identity? Chadtonia's Federal government only recognizes a persons anatomical features at birth as their legal gender, thus, the terminology "gender identity" does not have any signicance.
Does your country have employment laws that prevent discrimination based of gender identity? (see first question above)
Does your country have laws allowing anyone to purchase goods and services regardless of gender identity? (see first question above)
Does your country have laws allowing anyone to have a proper education regardless of gender identity? (see first question above)
Does your country have laws allowing anyone to have a proper healthcare regardless of gender identity? (see first question above)
Is your country's human rights institution or equality body (if they exist at all) mandated to provide rights and protection to all gender identities , or is it systematically working on this regardless of a mandate? These regulations fall under the Federal Council. There is no such body in Chadtonia.
Does your government operate an active policy of improving human rights, protection and equality explicitly to all gender identities?(see first question above)

Sex Characteristics

Does your constituition (or equivalent) includes provisions banning or limiting discrimination based on sexual characteristic? The term "sexual characteristic" has no meaning in Federal law, since Federal law only recognizes the anatomical features at birth as a person's gender. Later surgeries, or facial hair growth, or the like, are irrelevant. An anatomically male at birth is legally a "male", the same for "female." Chadtonia also has regulations for anatomically hermaphrodite, in which case the federal gender classification is "undefined." Undefined gender cannot be legally discriminated against in hiring purposes.
Does your country have employment laws that prevent discrimination based of sexual characteristic?N/A
Does your country have laws allowing anyone to purchase goods and services regardless of sexual characteristic? N/A

Gender Expression

Does your country law holds provisions to guarantee the right of gender expression?N?A

General

May LGBT+ people donate blood (or any kind of bodily tissue) equally as heterossexual people in your nation? Yes.

Family

Can same-sex couples marry with the same rights as different-sex couples in your nation? No. The Federal Government only recognizes marriages between a male and a female as a legitimate marriage. There are qualifications for undefined gender to be "acting male" or "acting female", but this does not apply to those with defined gender. However, Provincial laws may come into play.
Can same-sex couples enter into a civil partnership with the same rights as different-sex couples in your nation?
Can same-sex couples in your country enter into a civil partnership with weaker rights as married different-sex couples?

'legal gender recognition' since there are no legal documents that solidify ones identity here. However, you can enter a same-sex or opposite-sex marriage regardless of gender or sex in the Ashakadan Empire.
Are transgender parents recognised on birth certificates, documents, etc...? The few legal documents that exist-almost entirely relating to business or property-do not recognize gender or sex.

Is there a legal procedure for recognising a person's gender based on their own gender identity? Somewhat
Are there administrative procedures to change a person's gender based on their own gender identity, such as on official documents? There aren't any recognized official documents where one's gender or sex is documented.
Can someone of any age change their name without barriers? Yes
Is legal gender recognition based exclusively on the expressed will of the person concerned (without intervention of medical experts, judges, etc...)? There is no such thing as legal gender in the Ashakadan Empire

Can intersex minors receive non-necessary medical or surgical intervention before they reach the age of informed consent? Yes.
Are trans identities considered a mental health disorder in national clinics (or equivalent)? No, the Graces are known to preform regular sex changes. It's not actually that hard for them.
Is Trans-Specific Healthcare acessible to anyone without needing GID or GIC (Gender Incongruence in Childhood) diagnosis? Yes.

Are there any laws that prevent LGBT+ rights associations (NGO's or similar organizations) from receiving funds? No
Are LGBT+ human rights defenders arrested, harassed or harmed in your nation? Can they do their work without interference from the State?

Does your country have laws allowing anyone to have a proper education regardless of sexual characteristic?N/A
Does your country have laws allowing anyone to have a proper healthcare regardless of sexual characteristic?N?A
