A hybrid system in which civil law lays down the legal terms, definitions, criteria, etc, and maximum legal penalty. However, a judge and jury together determine the penalty for every crime ranging from a pardon to the maximum penalty.

Law in Pilarcraft isn't exactly set. We do have a Constitution, The Common Code, but every state is free to make their own legal systems so long as it doesn't go against The Common Code, as seen here. Different States have different Legal systems (both Common, Civil, and even Anarchic Law)

We have laws that are codified, but by imperial decree they can be overruled.

Civil law. The "will of the people" is sovereign, and sweeping changes to the law must be made by the Congress of Citizens, not judges. However, it has become customary for every Supreme Court ruling to be submitted to the Congress as a constitutional codicil (elaborating on a particular section rather than creating a new one), so many rulings are subsequently made into permanent law. A codicil requires a two-thirds majority, so many rulings do not pass, and if the ruling is rejected by a two-thirds majority, then the dissenting opinion is proposed (and almost always passed), and applied retroactively. This process has become relatively rare in the last few decades, as high-profile cases typically trigger a debate in the Congress before they even reach the Supreme Court, and if the Congress passes a codicil on the subject before the Sector Court makes its ruling (which obviously incorporates the new codicil), the Supreme Court simply refuses to take the case.

Gleissar (a part of an alternate timeline) uses a hybrid system that utilizes Constitutional, Common, and Civil Law in checks and balances to insure law and order with the least amount of government and the most freedom. The purpose of our legal system is to stablish justice, promote liberty, and eschew the extremes of anarchy and despotism. All member States must have republican governance (a viable Constitution, Common Law, and rules of Civil Procedure in that restrains Government from oppressing the Citizens and guarantees justice and liberty).

The Constitutional Law adjusts, corrects, and clarifies the Basic Law (an offshoot of Germanic Common Law with Anglo-Saxon, Gothic, and Reformation Influences) which guarantees each and every Citizen their individual rights, privileges, and immunities according to custom within the bounds of Natural Law (discovered and revealed in accordance to Nature and Nature's God.

The Basic Law (Stare Decisis, Habeaus Corpus, and rightly (justly) constituted Due Process, etc) assures that justice is met evenly and consistently as a sort of jus genitum based on 800 years of custom and 2800 years of legal principle expounded from the 10 Commandments, and man's duty to his fellow man. It is the shield that protects the Citizen against force and fraud from whatever source derived.

The Civil Law is the sword that restrains the Government from corruption and abuse, grants all aggrieved Citizens' their access to the courts without fee to make their case against any infringement, misprision, or violation of their rights, duties and responsibilities within and without the body politic. It deals primarily with safety (safety as in securing liberty and equality not as in ruining lives and livelihood or destroying freedom and common sense), contracts, torts, and regulation (regulation as in make regular, not as in control or hinder).

Reijekstan uses a hybrid system where the lower courts make their decisions based upon the established statutes, but where the decisions of the People's Supreme Court set precedents which are then codified into the civil law code.
