Immigration and Customs Enforcement Policy Plan, 2553

Since the February 11, 2552 ruling of the Interstellar Court of Justice that the immigration policy for over a century was unconstitutional, the United Colonies of Earth has virtually operated under wartime immigration controls similar to those in protectorates where active conflict is ongoing- that is to say, only authorized government personnel may enter or leave the country. As of 28 March 2553, however, the Diplomatic Division of the United Colonies of Earth, which controls the Bureau of Immigration and Customs Enforcement, has begun to come up with new plans for a future policy. Some of these have been put forth by ideologues and others produced by dry civic-minded public servants. Others are refinements of blog posts from the internet.
Based on similarities in each proposed policy, they have been synthesized into compromise policies with the policy plans most similar to them, and pared down in number to just three. Each plan will be voted upon on April 4 by the Oversight and Administration Council of the Diplomatic Division, and the plan which receives the most votes in favor will become adopted as a resolution for the workings of the Bureau.
The Division is publicizing these plans for international awareness and analysis. Included for the same reasons is the policy which was overturned by the ICJ.
This policy was developed by Casy Valesmadea, a member of the General Assembly and of the Human Defense League, and passed on January 4, 2501 by the Oversight and Administration Council hours after a Congressional mandate demanding such was signed by the Secretary-General of the United Colonies of Earth, Varo Mutinngu. Its' goal was to approach as closely as possible to the idea of closed borders, economic autarky, and full technological isolation without outright violating the Constitution, as the Human Defense League desires isolationism from outside influences.
It is an intensification of the prior immigration policy, which was introduced by a United Colonies Movement-Secure Borders Alliance coalition in 2436.
Immigrants and re-entrants
Noncitizens
The number of sapient noncitizens permitted into the UCE is 1 million per decade, of any and all entrants of any species. They are only allowed to enter into the UCE through ten planets in ten systems, known as the Intake-Outtake Planets, whose location shall be within the sectors directly in contact with the fringe of UCE space (i.e. its' "border" insofar as an interstellar polity possesses one) and whose identity shall change each decade (i.e. the ten planets selected for entry of sapient nonhumans will change every ten years). Entrants who attempt to bypass these planets will be shot down as hostile targets by UCEN, ATC and DSP forces. UCE ICE will maintain stations in orbit of these planets where all sapient nonhuman entrants will be processed.
All belongings will be confiscated and processed and the individual decontaminated and isolated in a sterile chamber for up to two weeks, and they are injected with radiation tracers. Weapons with a projectile or firing energy greater than 2 kJ are confiscated permanently and sent to Military Intelligence units for dismantling and possible reverse-engineering, along with any weapons sold as merchandise (the sale of alien weaponry is illegal). However, the total processing time is practically unlimited. Nonhuman entrants are interrogated as to their intentions and given a government datapad which contains a remotely triggered explosive, and which is returned to the Intake-Outtake Planet's ICE station from which they entered UCE space upon their departure. They are also assigned Prism Service officers to watch over them and report on their movements to the wider Prism Service.
Temporary travelers and tourists will be required to return to the Intake-Outtake Planet from which they entered into UCE space before leaving. Those who have come to sell things in the UCE must add a markup of 11,500% to the price of their merchandise or they will be removed from UCE space immediately.
Those who enter the UCE with the intention of becoming citizens will be barred from taking any job and will have to study or otherwise wait a period of at least 10 years before being allowed to take the Citizenship Examination. Passage of it with a score of 80% or higher will guarantee the aspirant the ability to take the oaths of citizenship at the nearest ICE facility.
Noncitizens as a whole have no rights except for protection from crime. They may be deported at any time for any crime.
Humans
Humans are strongly advised, but not required, to enter through the Intake-Outtake Planets. They are, however, redirected to them when welcomed into UCE space to undergo an identical procedure to nonhumans for decontamination and the checkover of belongings. They are then questioned by members of the International Relations Command of the Diplomatic Division about their place of origin, and asked to register to vote and buy property in UCE space. They are given a numerically equivalent amount of Colonial Credits to the money they currently possess, as only Colonial Credits are legal tender in UCE space, and pamphlets extolling life in a nearby colony in hopes of making them permanent, taxpaying residents of the United Colonies of Earth. There are no restrictions on their freedom of movement nor are there any Prism Service handlers for them.
Nonhuman citizens
Nonhuman citizens are subject to a policy similar to that which is applied to noncitizens. They will undergo decontamination and examination of their belongings. However, they will not be tagged with radiation tracers nor given Prism Service handlers nor datapads with remotely-triggered explosives.

Humans and nonhuman citizens
Citizens are required to report to an Intake-Outtake Planet before leaving UCE space. Citizens must surrender all personal belongings so that any weapons on their person can be tagged with radiation tracers, otherwise their departure will be delayed by at least three weeks as a penalty. ICE officers will ask citizens where they are heading outside of UCE space and if they are intending on returning. All assets in bank accounts will be frozen, and they must pay a fee of at least 14.4 billion credits. In addition, no citizen may leave UCE space with more than 1.9 million credits on their person.
Nonhuman noncitizens
A nonhuman noncitizen leaving UCE space will have their belongings examined. If they have sold any of them, then they must be sold with the aforementioned markup lest said nonhuman be fined for the additional uncharged price and barred from returning pending payment of that charge. They will be examined and any UCE-made goods confiscated from them before being permitted to leave.
Citizenship renunciation
Humans are constitutionally forbidden from renouncing citizenship, and the UCE is forbidden from denaturalizing them. All humans are automatically UCE citizens from birth until death.
The status of a former citizen in UCE records is fundamentally identical to death and as such, renunciation of citizenship, which is only permissible for nonhumans at Intake-Outtake Planets, consists of merely asking for it when prompted by an ICE officer at an Intake-Outtake Planet's ICE station. All services which are granted to UCE citizens are retracted from this person and all their funds are seized by the government and returned to the UCE's Treasury.

Imports
The UCE's policy for imports of materials undertaken by those who are not carrying them on their persons is that their quantity cannot exceed more than 1% of the quantity of the same class of UCE-made goods. Importation of weapons is outlawed and penalized with a fine of up to 50 trillion credits or 6 years imprisonment. Under special conditions importing weapons may also be classified as treason.
Exports
The UCE's policy for exports of materials is that no weapon can be exported, with the penalty being a fine of up to 50 trillion credits or 6 years imprisonment. If said weapon has an energy of more than 2,000 joules on firing then any act of exporting said weapon will be immediately upgraded to the charge of treason, which carries the minimal penalty of confiscation of all of the wealth of the condemned and the maximum penalty of death.

This policy proposal is a synthesis mainly of one proposed by the United Colonies Movement and another proposed by the Demographics Administration of the Scientific Division. As such, its' main goal is to preserve the human majority in the UCE and the secrecy of numerous indigenous technologies while permitting greater freedom of movement and trade.

It establishes a proportional quota for the entry of sapient noncitizens into the UCE which permits the annual addition of only one quarter of one percent of the number of nonhuman citizens or immigrants at the last decennial census per species to the population. Entry into the UCE will be at any planet, and all will have an ICE station in orbit ready to receive entrants of any species. Those who enter will be subjected to the standard weapons and biocontamination controls, with no weapon with a firepower energy greater than 2,000 kilojoules being permitted for civilian ownership and two weeks spent in a sterile chamber before entering into contact with the general public. Import controls will be relaxed from the earlier standards, with merchants not being required to add markups of 11,500% to their wares. However, merchants will be charged on their departure for 50% of the value of the sold merchandise. Nonhuman entrants will no longer be issued datapads fitted with remotely triggered explosives. However, the decontamination control process will continue to include the injection of radiation tracers, and in place of the datapads identity cards will be issued marking them as noncitizens.
Those who enter the UCE with the intent to become citizens or working nationals (immigrants) will be subjected to a reduced period of at least four years for the naturalization process. During this period they are permitted to work, but must also study for the Citizenship Examination whose passage with a score of 70% or greater will guarantee the aspiring citizen the right to take the oaths of citizenship at the nearest federal sectoral or subsectoral courthouse.
Nonhumans are granted protection from crime, but not freedom of movement, which may be altered by subdivisions of the UCE, or all civil and political rights. They have rights to freedom of thought and expression.
Humans and nonhuman citizens
Humans from outside the UCE will still be advertised to with requests to buy property in UCE space and to become residents. Decontamination controls for them will be relaxed compared to noncitizens- instead of a two-week-long stay in a sterile chamber they get a week's stay. Weapons controls will remain unchanged from those enacted for noncitizens. Import controls will be relaxed to the same level enjoyed by noncitizens as well.

Citizens are required to report on the day of their departure to the ICE facility at their port of departure. They will be asked if they intend to return to the UCE in the future and whether or not, if nonhuman, they would like to renounce their citizenship. If they do not intend to return to the UCE then 90% of their assets and wealth will be confiscated by the government. However, no money which they have on hand will be confiscated; any asset they have which is currently not within their reach may be taken in order to fulfill the percentage of assets and wealth seized. They will then be allowed to go either way.
Noncitizens
A noncitizen leaving UCE space will have their belongings examined and will be asked for 50% of the total price of any merchandise sold while in UCE space. All UCE-made consumer electronics, furniture, and accessories will be confiscated from them. They will then be allowed to go.

Humans are constitutionally forbidden from renouncing citizenship, and the UCE is forbidden from denaturalizing them. All humans are automatically UCE citizens from birth until death.

This policy proposal is a synthesis of one proposed by the Conference and Union and Democratic Unionist parties, as well as several found online and made by bloggers. It aims to increase ease of access for immigrants and non-resident citizens, and increase trade.
Immigrants and re-entrants
Noncitizens
Noncitizens will be subject to a decontamination period which, depending on the species, can last for up to two weeks. Quotas for entrants will be increased to 10% of the present population of citizens of that species, or 10% of the smallest population of nonhuman citizens. Entry will be permitted at any planet through said planet's ICE facility. An inquiry of one's belongings will be undertaken. But only weapons shall be confiscated from noncitizen entrants for examination. Weapons with a firepower greater than 2,000 J will be confiscated and sent to Military Intelligence for possible reverse-engineering.
The noncitizen will be asked of their intentions while in UCE space and assigned an identification card. Radiation tracers will not be injected into noncitizens during the decontamination process.
Noncitizens who state they require asylum or refuge from a hostile power will be asked of the identity and actions of said power and granted special identification cards marking them as asylees or refugees. The refugee quota is 10% of the total UCE population. Noncitizens who have arrived with intent to become citizens will be allowed to work in the UCE while studying for the Citizenship Examination. They may wait for as long as they please before taking it. However, during that time they must annually report their status as a UCE national. Nationals may have movement restrictions enacted against them by planetary governments and cannot be charged with treason. They may be deported from UCE space or imprisoned without trial if found to have committed any crime and cannot vote in federal elections. Nationals must pass the Examination with a grade of 75% or greater in order to become citizens. The oaths of citizenship can be recited at any government facility to any government official.
Nonhuman citizens of polities which have a human majority population or are members of the Multi-Species Alliance, along with asylees and refugees, are granted Special National Status, which is similar to citizenship in that they are granted all the rights provided under the Universal Declaration of Human Rights and Seattle Declaration of Sexual and Gender Minority Rights. However, they may be deported and their status revoked for any felony. This status is transferable to spouses or children who are themselves not UCE citizens.
All other noncitizens are protected from unreasonable searches and seizures, long imprisonments without information or trial, and granted freedom of expression. They may be deported for any crime. Freedom of movement may be restricted by any UCE subdivision.
Humans and nonhuman citizens
Advertising of properties and voter registration to returning or entrant citizens will cease; all citizens returning from outside of UCE space will simply be allowed passage at spaceports without having to report to an ICE kiosk.
Emigrants and others traveling outside of the UCE
Humans and nonhuman citizens
Citizens will be allowed to leave without needing to report to an ICE kiosk at their port of departure. But if nonhumans wish to renounce citizenship they must first report to the ICE kiosk or station in their port of departure. There will be no charges for leaving the UCE without intention of returning.
Noncitizens
Noncitizens will have any consumer electronics, furniture or weapons confiscated from them before leaving at their chosen port of departure.

This is a revision of the overturned policy promoted by the Human Defense League, Alliance of National Sovereigntists, Organic and Proletariat Citizens' Representatives and the Interstellar Socialist Party. It has had its' restrictions on citizen freedom of movement removed but is largely similar to the overturned policy otherwise.
