Abortion in all parts of the Empire is completely legal, and even completely free from any monetary charges. Due to the advanced medical technology available, abortions are painless and easily carried out at any moment during the mother's pregnancy, save the first few weeks and the last month. The law does not consider the foetus a human being until it is born, and therefore no human rights are being breached.

As the Konservative Partei (Conservative Party) is in control of the Kongresszus (congress), abortion is outlawed with the exception of the mothers life being in danger or certain cases of rape or incest.

Completely illegal, unless the mother is in danger or the baby is no longer alive. Punishment is 50 years for the operator, and 35 years for the recipient. If they citizen travels out of country to have one, they are at risk of losing their citizenship.

Abortion is illegal and is classified as Murder and Apostasy and the fact it is a per-pubescent child the charges are even harsher, though murder is a mandatory death sentence when it is conducted against a child the method of execution is harsher. Regular murder would be a shot to the head whereas abortion is punishable with beheading or stoning.

Legal on demand. The CTM's probably more liberal than IRL Scandinavia. Also, due to the CTM's national health service it's free.

Abortion is completely illegal in Centralium, and abandoning the child is also prohibited. Victims of rape however may abandon the child conceived to the custody of the State.

Following a 1979 decision of the Republican Court of Cassation, criminal restrictions on abortion became unenforceable. No replacement legislation was ever written.

Abortion is a decentralized issue. The Komitetas or Komiteja of each province decide on the issue. It is illegal to have an abortion performed in a province you don't have residence in.

According to the Hokomian Constitution. Abortion is legal in cases of rape and incest, foetal abnormality, where the pregnancy could damage the physical or mental health of the mother, or where the mother can provide any other reason seen as valid by her doctor (i.e. because she cannot afford to have the child). It is allowed up to 14 weeks in most cases, but can be extended to 18 in cases of rape and can be done at any time to save the life of the mother.

Instead of abortion, we extract the fetus and transplant it into an artificial or Human womb. We view this procedure as an acceptable compromise between pro-life and pro-choice views on the issue, since it allows women to "end" a pregnancy but spare the child's life.

Abortion is not addressed in Confederacy-wide law, but many member states have banned it in favor of transplantation.

Abortion in Pharexia

Postby Pharexia » Fri Jun 07, 2019 2:45 pm

Abortion is illegal at all stages of pregnancy and for any reason except to save the life of the mother in the Theodemocracy of Pharexia. Compared to other developed nations, Pharexia is an outlier with its extremely restrictive laws governing the practice. Since there is no explicit legal reference to abortion in the 1900 Common Law, the federal Constitutional Tribunal has allowed both ward legislatures and the national parliament to restrict or ban the procedure entirely. In 1981 AD, the Liberal Justice-led Síðari passed the Devolution of Abortion Act, which barred the federal government from overriding ward statues on the practice. This resulted in the more liberal-learning wards (Brichard Proper and Clayp Thines) liberalizing their laws and conservative-leaning wards (Uxbridbury and Victorium) restricting their laws. However, many were concerned about the legal inconsistency, which allowed those who lived in wards where the practice was illegal to travel elsewhere in the country to obtain an abortion. The 2014 Pharexian general election was centered around resolving this issue, with the Conservative Coalition (The Conservative Party, New Future, and the Ilyçian Delegation) promising to repeal the DoA Act and introduce legislation to federally ban abortion. The two main opposition parties, the Liberal Justice Party and the Science Party, campaigned on retaining the act, with the Écologists remaining neutral and the Dignity Party calling for a federal bill to legalize abortion nationwide.

Six months after winning the 2014 election, the Conservatives introduced legislation to overturn the 1981 DoA Act. It passed easily and was signed by the President, effectively neutralizing all ward laws relating to abortion and returning legislative power to the Síðari. Since the passage of that bill, the Federal Government has passed several pieces of follow-up legislation, most notably the 2019 Right to Life Act, which banned abortion without exception across Pharexia, with the caveat that wards may decide whether or not to allow the procedure in cases of maternal danger. This means that, in wards that permit it, a person who procures an abortion in good faith for the purpose of preserving the life of the mother is not guilty of an offense. Life in this context means that the continuance of the pregnancy would adversely affect the physical health of the mother. The adverse effect must, however, be a real and serious one and there will always be a question of fact and degree whether the perceived effect of non-termination is sufficiently grave to warrant terminating the unborn child. It is unlawful to procure a miscarriage where the fetus is abnormal but viable unless there is a risk that the mother may die or is likely to suffer long-term harm which is serious to her physical health. The Right to Life Act states "termination of a pregnancy based solely on the abnormality of the fetus is unlawful and cannot lawfully be carried out."

Pharexia had numerous ward-specific abortion laws from between 1981 AD to 2014 AD. These often times differed significantly from one another but generally were amongst the most conservative for their time. Despite political discrepancies, each ward had the following restrictions in place:
  • The procedure could not take place on request
  • The mother was obliged to undergo a week of 'advisory sessions' which instructed her on the abortion process, the arguments for and against, the legal and religious framework, and allowed her to ask questions;
  • The mother was obliged to meet with a representative of the State Church;
  • The mother had to wait a full week between the last of these 'advisory sessions' and making the final decision; and
  • The procedure had to take place at a registered and licensed hospital by a medical doctor.

In the Achaean Republic, abortion is legal until the 25th week of pregnancy for all women, though certain restrictions vary by state. Women in the public healthcare system must express their desire for an abortion to a trained medical professional such as a gynecologist or a primary care physician, who must then undergo counseling and a waiting period (dependent on each individual state) before deciding to go through the process.

Women who wish to undertake an abortion in the private healthcare system must pay upwards of $500 USD to do so, but are still required to perform the same counseling processes as those in the public system. For this reason, a 2017 study from the country's statistics institute revealed that more than 90% of Achaean women prefer to have their abortions in the public system.
