Capital punishment in your nation?

Just as the topic states. What is your nation's view on capital punishment? Why or why not?

In the DRY, or Democratic Republic of Yukonastan, we do have capital punishment. However, we have VERY strict regulations regarding on when the death penalty, life imprisonment, or exile is considered the appropriate sentence.

First off, let us look at the death penalty. The requirements for a death penalty to be an option are very slim. You must have committed murder in the first degree, multiple murders, or committed treason, you may not have been approved for an insanity defense, and there needs to be absolute proof that you did it. Once that's done, and the judge rules you guilty of first degree murder punishable by death, you will be taken through one of the more morbid stages of our judicial system, and you will decide on your method of death.
The choices include:
-Nitrogen asphyxiation
-Gassing
-Lethal injection
-Electric chair
-One in the back of the head
-Firing squad
-Hanging
-Whatever you come up with

If it's life in prison you're looking at, again, you must have committed a serious offense that warrants it as a punishment. Manslaughter isn't serious enough, as it was accidental. Murder in the third and or second degrees, if single murders, is considered punishable by life with parole at twenty-five. Same restrictions on issuing the sentence apply, you may not be eligible for insanity defense, and there needs to be absolute proof of your involvement. Other reasons for giving life in prison would be assisting with first degree murder or treason, and in the latter case you may also be exiled for life.

After the court issues one of the three capital sentences, it will be dismissed, and all members will be investigated for the decision taken by the court. If the decision was in error, the convict-defendant is pardoned and put on a new trial, to determine a proper verdict. The previous sentence is null and void. If they are sentenced to death, the death penalty is scheduled to come only after the investigation of the court is complete in its entirety. A similar process applies to those who are sentenced to life in prison with parole at a quarter century, and to those that are exiled. They are pardoned for the new trial, and the result of that second trial decides whether they go back on Death Row, or to the long housing sectors of the prisons, or back into the nomadic lands to our north. If the evidence proves to be inconclusive, then the defendant is pardoned outright.

In Britannia I The death penalty is the sentence passed to the most serious career criminals and offenders. Though generally frowned upon citizens do not seem to be fully on protesting for it to stop.

The crimes for which capital Punishment is used are:
-First degree murder ( Someone going out of their way to plan and later act on killing someone)
-Treason (attempted assassination of CSM's, the Emperor or any political figure and handing military or national information without permission)
-Piracy (Stealing cargo and supplies from ships in Britannian waters)
-Terrorism (mass hostage taking, damaging landmarks using explosives and killing Citizens in the name of an organisation or religion)

Method
-Hanging (Civil Law)
-Firing squad (Military law)

Also under Britannian law, pleading insanity or mental illness will not lessen the sentence. If you are found guilty of any of the above crimes you will be put to death. The best thing people could do would be to put in a Mercy plea with the court and they will review all evidence again to make sure that nothing is missed before re-sentencing again.

Murder, high treason, violent kidnapping and rape are all punishable by death, which is mainly delivered via a firing quad, gassing or hanging in the Labour Camps.

Anything less than these crimes is punished via life imprisonment without parole or a period of incarnation, both of which occur in a Labour Camp.

Death penalty specifically isn't an actual punishment outside of the military, since the standard ones aren't practical overseas. The most severe crimes, such as most forms of murder (including mass murder), are punished with one of three punishments that are inevitably lethal, so I guess technically you could say it's a capital punishment. Experimental test subject or pathological culture, forced gladiator combat, and suicidal penal duty are the three punishments, with which ones being available being dependent upon the crime and individual. For example, criminals of a sexual nature are not permitted to do gladiator combat, and people too unstable, brainwashed, or otherwise incapable of carrying out desired orders cannot perform suicidal penal duty.

So, technically no, but in reality yes.

Can you theoretically ask to be thrown into acid or to be tortured to death or to be dissected alive without anaesthesia?

Anyway, Medwedia has LOTSA capital punishment, and we DO in fact use the three methods I stated, especially for serious crimes.

In Fatatatutti, capital punishment is considered worse than anything the victim could have done. It is the cold-blooded, ritualisting killing of a helpless person. No society that perpetrates such a crime on its own members can consider itself civilized.

Capital punishment is reserved for the most severe of crimes in the Empire and not handed out lightly. Cases are thoroughly investigated before such judgment is passed down as it is known that such judgement is final (mostly). That being said applicable crimes for capital punishment, that is execution, is high treason, desertion, premeditated murder and rape. As to methods there is simple hanging by the neck for most cases and death by firing squad for traitors and deserters.

In The Dark Plamz, Capital Punishment is used on criminals only when they have been brought forward to the emperor himself, and he himself choices it. while this was used alot in the nations starting days, most opposition is underground, so it is only used rarely, but when it is used, its brutal.

Yes, we have it. Like most nations, we implement it on those proven guilty of crimes that are deserving of death.

Methods of execution are usually hanging or lethal injection or whatever else the guilty party is sentenced to be killed by.

The use of capital punishment within the United Provinces of New Korongo has been banned since the First Korongolese Civil War. Individuals who are convicted of crimes that warrant capital punishment in other Western countries are instead sentenced to life imprisonment. Capital punishment is generally viewed in a negative light by members of the public. It is commonly criticised for the fact that it cannot be reversed if a person is found innocent after sentencing. Many citizens of New Korongo also feel that the death penalty is an escape from punishment, as opposed to a means of punishment.

Capital Punishment in the Monavian Empire


General Principles

The Monavian judicial system and the laws it interprets have both been influenced by the country's highly deliberative political culture and the moralistic principles established by its religious institutions over the past thirteen centuries. For hundreds of years the central government and provincial governments have both recognized that the ramifications of employing capital punishment are grave enough to merit serious contemplation by legislators and judges alike, so it is little wonder that Monavians have historically recognized that only a few forms of crime are sufficiently heinous to warrant the penalty of death.

The Monavian Constitution created a federated governance model that allows individual provinces, territories, and the Capital District to enact their own legislation, establish penalties, and constitute internal tribunals, so a thorough summary of the variegated selections of crimes warranting the death penalty in each province is too extensive to cover here. Instead, the scope of this article is limited to the subject of capital punishment for crimes against the Monavian Constitution and statutory laws contained in the Monavian Imperial Code.

Capital Trials

Capital trials function according to more stringent procedures than those utilized in standard criminal trials. The prosecution is required to satisfy a greater burden of proof than the one required to prove guilt for lesser offences because the credibility of the Monavian judiciary would be compromised by a miscarriage of justice as severe as the execution of an innocent party. Whenever a defendant is indicted on capital charges, the court will order the imposition of special security measures, including the incarceration of the defendant in a high security section of the courthouse jail and the detailing of heavy guard escorts to accompany the prisoner to and from the courtroom. If the defendant is convicted, the law mandates that the sentence of death be pronounced within forty-eight hours of conviction unless extenuating circumstances prevent the court from complying with this requirement within the allotted time. Furthermore, the Code requires all courts in which capital cases are tried to remand convicted defendants to a prison facility that is sufficiently equipped to both house and execute them within ten days of sentencing. In order to provide the judicial system with sufficient time to process appeals, the law also requires that the soonest possible date of execution be set no earlier than one year after the day on which the death sentence is first pronounced. All appeals must be initiated by the defendant's counsel because automatic appeals are not permitted.

A number of things can happen after a capital prisoner has been sentenced and remanded to an appropriate prison facility. The law generally requires executions to be carried out no later than five years after the date of sentencing, but this date can be adjusted according to accommodate the needs of justice. Prisoners who have been convicted of other crimes must remain alive in order to serve sentences ranging from paying amercements to corporal punishment and imprisonment for short periods, often resulting in the date of execution being postponed until these sentences have been completed. A capital criminal who is placed on trial for another crime while awaiting execution must likewise complete the trial, and if convicted, serve the appropriate sentence.

Executions

The Monavian government conducts all executions in accordance with the principles of justice prevailing among the judicial systems of civilized nations. Accordingly, Monavian law forbids crucifixion, impalement, burning at the stake, scaphism, breaking on the wheel, flaying, scourging, drowning, crushing, stoning, tearing apart by animals, feeding to wild beasts, gladiatorial combat, and sawing in half, as these methods of execution bear a form of opprobrium befitting only to savages. At the present time, Monavian law permits execution by hanging, beheading by guillotine, firing squads, electrocution, and gassing with nerve agents.

Hanging is reserved for criminals found guilty of any of eight crimes known as the Abominations: crimes against peace, crimes against humanity, crimes against the laws and customs of war, genocide, high treason, serial murder, serial rape, and slave trafficking. Instructions for performing every part of the hanging procedure from the construction of the gallows to the removal of the corpse are detailed in official documents used by the executioners. According to official procedure, the gallows must be constructed according to an automatic “Julian” design and must be erected in an open-air prison courtyard. The entire bottom section is enclosed by an opaque curtain that may not hang any higher than two inches above the ground and may only be entered by the hangman and the physician tasked with pronouncing the prisoner dead. The gallows is tested several times before the condemned is led out to be hanged, at which point a chaplain says a short prayer and the condemned is asked by the hangman to make a final statement to the observing parties, which include the prison warden. The hangman is responsible for removing the dead prisoner and the noose once the execution is complete.

Beheading is reserved for criminals convicted of petty treason, terrorism, premeditated murder, capital rape, capital robbery, and capital torture. The law requires that the guillotine be erected in an open-air courtyard and tested several times prior to actual use. The execution must take place during the day, preferably after dawn. The condemned may make a final statement at the discretion of the warden.

Firing squad executions are reserved for enemy spies and military criminals found guilty of treason, desertion, mutiny, perfidy, and other capital crimes. A firing squad consists of twelve active-duty enlisted personnel chosen by lot (noncombat personnel and conscientious objectors serving with reservations are excepted from selection). Each member of the squad is issued a large caliber bolt-action rifle and the appropriate ammunition (ten of them receive two live cartridges apiece and blanks are issued to the others). On the day of execution, the condemned is roused one hour before dawn and given time to dress and have a session with a chaplain. Once finished, the condemned is led in front of a berm of compacted earth and offered a cigarette and glass of brandy by the detachment commander in accordance with long-standing custom. The commander blindfolds the condemned if requested and orders the squad into position for firing. When dawn arrives the squad is ordered to fire a single volley.

The electrocution and nerve gassing methods are very rare and are not reserved for any specific set of capital crimes. In 2011, the Monavian government announced plans to phase out nerve gassing by 2016 and phase in the use of hypoxic chambers according to the Fegosian model by 2014.

Yes, capital punishment is very much an institution in our Holy Empire.

Generally, crimes punishable by execution consist of the traditional heinous crimes of murder and rape. In addition, execution followed by burning is the penalty for witchcraft, summoning, and other forms of extreme heresy. Local lords are allowed to choose the method of execution, the only requirements being that it must be relatively humane, efficient, and public. Generally, firing squads are favored by urban lords, while country rulers prefer hanging. Gassing and the electric chair are occasionally used, but are typically considered too expensive.

Capital punishment was abolished in Gandoor in 2003. The last person executed in Gandoor was executed in 1997. It was abolished primarily for being so rarely used, it was decided it was unneeded. (For reference, in the period of 1903 until 2003, a total of 12 people were executed* and at the time the death penalty was abolished, three people were still on death row nationwide)

*Not including the period of 1940-1951 when many were executed or worked to death by the brutal totalitarian regime which ruled Gandoor during that period.

Capital punishment was abolished decades ago, and has been replaced by rehabilitation and life in isolation.

The capital punishment is performed in the Greater Aztec Empire to deal with the most severe crimes.

The criteria for the most severe crimes are treason, corruption, drug smuggling, sexual assault, assassination, and terrorism.
The capital punishment for the most severe crimes are hanging, fussilading, electrocution, injection, or asphyxiation without mercy.

Before the convict encounters the capital punishment, he or she must undergo a series of rehabilitations for at most 10 years.
If the convict cannot fix his or her mistakes, then he or she must undergo the capital punishment with his or her preferred method.
If the convict can fix his or her mistakes, then he or she must undergo at least 25 years of imprisonment in a maximum-guarded prison.
Based on the latest statistics from the Ministry of National Security, there are only 10% of the convicts who prove capable to fix their mistakes.
