The English Version of the Constitution of Kalaspia-Shimarata
Introduction
The Constitution of the Union of the Federation of Kalaspia and the Federation of Shimarata. The Supreme Law of the land and governance of the nation united under All Mighty God; The Father, the Son and The Holy Spirit; The Three Persons of of the Holy Trinity

Kalaspia-Shimarata's flag represents the Union between K&S. The dark blue represents the sea and the light blue represents the sky. In Kalashi language considers light blue and dark blue to be different colours. England colonised, and unified K&S, between 1774 and 1953, and English, light blue and dark blue are considered to be the same colour. Therefore, the contrast between dark blue and light blue represents the union, but the differences between K&S where as blue being two but simultaneously one colour represents K&S being two, but simultaniously one entity. The opposite to the symmetry represents the unity and indipendance of K&S, whilst also representing the Kalashi culture of opposite symmetry.KS is 75% Christian, hence the cross.

Under God Almighty, may our nation remain united and sovereign, and may our nation retain His law until His return to the Earth, which he created. Until the return of Jesus Christ, God Almighty, the Son of God and one of the three persons of the Holy Trinity, may this constitution govern the great nation of Kalaspia-Shimarata

Article I
The Stance of Kalaspia and Shimarata


Kalaspia and Shimarata, two separate nations which united circa 456 Anno Domini after the marriage of the king of Kalaspia and the queen of Shimarata, are now two separate federations. Kalaspia and Shimarata shall be the two confederate states of Kalaspia-Shimarata.
Travel between and within the states of Kalaspia, the states of Shimarata, and between Kalaspia and Shimarata may pass openly and freely, without any hinderance. The travel of citizens will also be free of charge (excluding the cost of transportation), and not requiring any identification. With the exception of a war, which splits Kalaspia and Shimarata in to two seperate nations. Each of the two nations shall have their own pre-prepared constitutions in preperation of such an event.

Kalaspia and Shimarata shall be held of equal importance to eachother, at all times and under all circumstances, and shall assist eachother in times of war, unless of coarse, at war with eachother.

Article II
Monarchy and Democracy


Section I
The monarch of Kalaspia-Shimarata shall be known as the "Kalashim"

Section II
After the marriage of the King of Kalaspia and Queen of Shimarata, Kalaspia-Shimarata was ruled by absolute monarchy. However, in 1942 Anno Domoni, when communists over-through the Shimaratan monarchy, the monarch had decided to impliment capitalism in Kalaspia and thus creating this constitution. By royal decree of the Kalashim of the time, the nation will be a democratic nation.

Section III
Elections shall be held every four years, or more often if initiated by citizens. Elections must be fair and even. In order to ensure fairness and truthfulness of the elections, the counting of the votes must be broadcasted publically, where any citizen is free to watch, without a charge of money or any other commodity. Thee counting of votes must be public. The counting of votes must also be broadcasted over the radio, on its own station (1958 AD ammendment) and on television on its own channel (end of 1958 ammendment AD). The counting of votes must also be monitored by three indipendant commitions

Section IV
The role of the Kalashim is ceremonial, and will have no politial power. However, all members of the royal family are free to run for politics. Any member from the royal family who enters politics will have the same rights and responsibilities as comminors, however, will not recieve any special priorities, entitlements or rights. Royal family members who enter politics will not recieve any more power than comminors

Section V
The political head of state shall be elected, and a different person to the head of government. No member of the cabinate, or opposition parties, may run for head of state, nor any former members of any party

Section VI
Voting shall be optional for all citizens 16 years or older. Compolsury voting is not permitted[/b]

Section VII
In order to run for politics, a person must be 16 years or older, and must pass an IQ test

Article III
Citizenship and The rights of citizens


Section I
Citizens and non-citizens have the right to free speech. Citizens and non-citizens have the right to criticise the any politician or member of the royal family. Citizens and non-citizens have the right to criticise the government. Citizen and non-citizens have the right to criticise the nation or military within reason. Citizens and non-citizens also have the right to critise the flag and the national anthem. Laws concerning deliberate burning of the flag, however, may be determined by the government

Section II
People are free to emigrate from, or immigrate to, Kalaspia-Shimarata. Emigrants have the right to retain citizenship if they desire, whether or not recognised in the nation that he/she is migrating to

Section III
The government does not have the right to regulate the media, within reason. The government does have the right to prevent the media from interfering with people's personal/private lives, but no other regulation of the media

Section IV
Neither government nor private coperations are allowed to give exclusive rights to non-citizens. Whether this be exclusize access, discounted prices etc. Citizens are entitled to equal, or greater, oppertunity.

Section V
The government does not have the right to oppress civil rights. Every man and woman in the nation, whether or not a citizen has rights. These include the right to drink (alcohol), to smoke, to perform, broadcast or watch anything they desire, to use coarse language etc.

Section VI
Conscription shall not be implimented in times of peace

Section VII
Anybody born within the borders of Kalaspia-Shimarata, be it land borders or sea borders, is automatically a citizen, despite the nationality of his/her parents. However, one may lose his/her citizenship as a punishment for treason

Section VIII
Citizens and non-citizens accused of a crime are entitled to a fair and even trial, and are innocent until proven guilty. The trial shall work on the basis of a jury of twelve members, each vote must be unanimous

Section IX
Kalaspia-Shimarata shall remain a common law nation

Section X
Migrants and decendants of migrants are permitted to embrace and even celebrate the culture of their origin, but must however place Kalaspia-Shimarata first, assimilate into Kalashi culutre and at times of a conflict between Kalaspia-Shimarata or their nation of origion, Kalaspia-Shimarata must win

Section XI
Citizens have the right to intitate elections and referenda. In order for any part of this constitution or any major laws to be passed, a referendum must be hosted

Section XII
Education shall be free and open to all. The educatution system shall serve the purposes of educating and enlightening the peoples of the nation

Section XIII
Large Coperations nor the extremely wealthy have the right to

Section XIV
(1998 AD Ammendment) Taxation must not exceed 35%. This includes all types of taxation combined, including value added tax, income tax etc.

Section XV
Every human, form every nation, has the right to apply for citizenship, conditionally

Section XVI
Only humans may apply for citizenship

Article IV
Equality


Section I
Let it be written into this constitution that every man and woman in Kalaspia-Shimarata be born free and equal, regardless of gender, ethnicity and skin colour.

Section II
All citizens, whether or not born in Kalaspia-Shimarata are to be free and equal. Citizens born in Kalaspia-Shimarata are not entitled to any more rights than citizens who were not. Citizens who were not born in Kalaspia-Shimarata are not entitled to more rights than citizens who were. This applies to people born in friendly, neutral and unfriendly nations, as well as Kalaspia-Shimarata.

Section III
(2005 AD Ammendment) Materinity and Paternity leave shall be paid by the government

Section IV
In the name of equality, a basic level of feminane hygine products will be provided to women, as men do not menstruate

Section V
Skin colour, ansestory, or the nation where a citizen was born does not effect the rights, citizenship status, the right to work or any other rights or entitlements given to citizens

Every human has the right to apply for citizenship conditionally
