Constitutional court in your nation?

Postby Iglesian Archipelago » Mon May 16, 2011 11:01 am

Does your country have a constitutional court?

The Iglesian Archipelago has the Iglesian Constitutional Court, which deals mainly with constitutional law, ruling on laws which may be considered to be unconstitutional or not.

The building of the Constitutional Court is this:

The Saurisian Constitutional Court, a Court made up of 7 Judges who help decide what is and what isn't Constitutional.

Due to having an unwritten constitution Kalumba has no constitutional court, instead we use a select government committee.

Alterrea has not a Constitutional Court.
A Sovereigns Coucil has to settle issues than can arise between the Sovereigns of the Community: the Leader, the Patricians (the - now elected- Nobility) and the Freeborns (the Common people, Freeborn is a tentative translation into English: there has never been slaves in Alterrea). The Sovereigns Council's decisions are based on the Original Vow (or what it supposes to be the "Original Vow"), custom and its previous decisions (but only the Original Vow is binding, despite the precise wording of it, it is unknown because the Vow is about 2000 years old...).
The Patricians settle their own issues through the Senate (which is also their legislative body), the Freeborns have a Constitution, but they have not a Constitutional Court in its own right: issues are settled by a specific committe of the Community's Supreme Courts (which, despite their names, are "Cassation" Courts, not "Supreme" Courts) and the Leader settles His own issues by Himself!

The Royal Constitutional Court is Tsvarchi's - you guessed it - constitutional court, whose purpose is to interpret the Supreme Laws of the Land to determine if the case before the chamber is constitutionally sound or not. It has eight directly elected justices, one from each borough, called Justices, and then a single Chief Justice appointed by the Monarch with confirmation by the Royal National Assembly. All justices serve for an unlimited 12 year term, unless recalled.

The Haupttribunal serves as the "constitutional" court, as it deals with interstates conflicts, issues of civil and political rights, and other things covered by the Frenequestan Constitution. It has five members that serve so long as they maintain exemplary standards of legal reasoning and are reviewed regularly by independent bar associations.

we are a government by whim, what fearless leader wants, fearless leader gets. Luckily for us, he is a happy go lucky sort of despot. He really is not to demanding of his people, do your morning mandatory aerobics (lead of course by fearless himself), do not mention his bald spot, and you are pretty much OK.

On tort type of cases there is a judiciary with an appeals court, but it can be overruled by the whim of fearless leader anytime, for any reason. For example making fun of a growing bald spot is a capital offense in Ethel Mermania.

If an appealed case goes against a client, an appeal to fearless can be made, by either party. Usually he ignores them, but every once in a while he gets on his high horse and makes some ridiculous decision, usually not what either of the parties wanted, and poof it is law of the land.
The West won the world not by the superiority of its ideas or values or religion … but rather by its superiority in applying organized violence. Westerners often forget this fact; non-Westerners never do.

The most fundamental problem of politics is not the control of wickedness but the limitation of righteousness.

We have three layers - the Court of Judicial Review, the Court of Appeal for Judicial Review and the ArghNeedAName Supreme Court.

Only the Supreme Court can strike down Acts of Parliament for being unconstitutional. The CoJR and CoAJR serve as a "filter" for judicial challenges. The CoJR and CoAJR can strike down Presidential Decrees and other forms of secondary legislation.

Since no legislative act passed by the Lord President can be unconstitutional, and only the Lord President may pass legislative acts, there is no need for such a court.

There is, of course, a court for the Judicial Review of the acts of omissions of lesser rulings...

The Supreme Court of Patoran is the highest court both for statutory and constitutional cases. It has eleven members.

The Supreme Court never hears cases by appeal; rather, the primary source of its docket is a committee of randomly-selected appellate judges that meets every few months to decide which appellate cases ought to receive Supreme Court review. If it wishes, the Supreme Court can also affirmatively decide to review a case decided by an appellate court, though such cases are by far the smaller share. Even more rarely, about once a year, it also hears constitutional questions certified to it by Parliament regarding proposed legislation in that body.

The Hoë Raad van State (High Council of the Estates) is the Commonwealth's constitutional court. It deals with constitutional affairs, checks laws and treaties on it's constitutionality (as checked by the Eerste Kamer of the States-General), has the power to overturn verdicts by appeal courts and mediates between the various regions and deals with citizen's grievances against the Government on any level.

There is none per se; however, two bodies come close:

-The Supreme People's Procuratorate.

-The Constitutional Commission of the Supreme Soviet.

In practice, however, interpretations of the Constitution are made by:

-The Central Committee of the Communist Party

We have no such court. All laws are reviewed by the Presidential Council, or Consejo Presidencial. It is comprised of the President, the Vice President, the Minister of Internal Affairs, and Premiers of the 11 (to become 12) Provinces in Costa Fiero. They determine what is and what is not unconstitutional based on their best interperetations of the Centennial Constituition adopted in 1960.

The High Court is the authority over all constitutional law in the Harrowlands. It has the authority of constitutional interpretation and judicial review and can enforce constitutional law upon Parliament when need be. It has original jurisdiction over all constitutional matters. The High Court also has a number of other functions, including being the highest regular court of appeal (apart from the Courts of High Appeal, which are rarely used today and have other functions themselves). The High Court has original jurisdiction in matters arising under any treaty, matters affecting consuls or foreign representatives, matters in which the Crown is a party and matters in which a mandamus or prohibition or injunction is sought against an officer of the Crown.

The unelected, monarch-appointed High Council is the highest court in the land (it is also the body that runs the country on a day-to-day basis), although even its decisions can be overruled with unfettered ease by the monarch.

Of course not. We have a High Tribunal that can deal with any issue. Similar in function to many nations Supreme Court, the High Tribunal is an august body of 15 judges that can rule on any issue, including whether or not legislation in Lower Alberton is constitutional.

I'd love to show you a picture of its new beautiful building, but its under construction. The current location is in an office building in downtown Alberton City.
