International Copy Right & Patent Laws

Postby GOLTZBORG » Sat Apr 16, 2011 8:21 am

Does your government abide by any or all of the International Copy Right and/or Patent Laws; or instead, does your government allow for the manufacture, marketing, distribution, and selling of such intellectual property rights, without the proper prior consent and payment of royalities commonly associated with such commercial enterprize exchange ?

The Ministry of Justice oversees all copyright in Thurask, domestic or foreign. It has the power to deny the validity of patents/copyrights/trademarks/etc. in Thurask if it finds them to be frivolous, monopolizing, etc. However, copyright infringement is only enforced once in a blue moon (and even then, the punishment is a small fine), so most Thuraskis enjoy a steady stream of music, movies, video games, software, etc. for free on their government-subsidized Internet connections. This irreverence is mostly due to the shared idea that copyright is a capitalist construction built to help the businessman strangle the artist. Instead, most artists/developers get a government grant so long as they keep producing what they do.

Our culture doesn't have a strong concept of property ownership at all, much less a concept of "intellectual property".

It is possible to sue somebody for "stealing your idea" only if you can prove that you were harmed in some way. For example, if somebody produced a cheaper knock-off of your invention, you'd have to show that you lost actual income because of the competition, not just potential income.

It is certainly possible for a foreigner to sue a Fatatatutian in Fatatatutian courts in such cases. Otherwise, we don't recognize any foreign opinions on the matter.

No, we only recognize a licence like copyleft or creative commons. We are also notable that we dont respect other nations copyrights...

Our nation does not have patent laws, so if you want something to be private, you don't tell anyone. "Copyright" in our nation lasts 20 years or until death, and grants the holder all of the profits. It does NOT, however, limit distribution, as this would be an infringement on free speech. Therefore, it is legal to copy a work, but any profits you derive from such copies belong to the copyright holder. Culture also plays an important role: Our culture views it as extremely disreputable to profit from the work of others, and so commercial piracy is largely nonexistent and the profits end up with the copyright holder anyway. Filesharing, on the other hand, is common and entirely legal, as no profit is derived.

The Front Range has a "reciprocal" policy; they respect ours and we respect theirs, they ignore ours and we ignore theirs. The Front Range has common sense intellectual property laws; they aren't strictly enforced here because they don't need to be but are considered important.

Being a nation of scientists and inventors, we take patent and copyright laws very seriously. Disputes over "who thought of what first" can get very ugly.

We recognise international copyright laws, except for restrictions on distribution.

The Neo Athena Patent Office operates on a simple "first come, first serve" policy. Patents are granted between 10 and 25 years duration pending the Patent Board's decision, and the holder is entitled to a minimum 10% of total profits. Patents cannot be renewed. Foreign patents do not apply in Neo Athena, nor do we expect Neo Athenian patents to apply elsewhere.

We recognize intellectual property of all people, foreign and international, whom invest in Vermont. However, we do not give preference to the exact protections of foreign patents, and intellectual property is recognized of foreigners exactly as it would be with any of our citizens in Vermont. The ownership, however, is recognized under Vermontian law.
