This bill wishes the recognise that the right of initiative for the Council of Ministers is one that must be instituted to be a fair and democratic nation. All contemporary democratic nations using either the parliamentary (the United Kingdom and Denmark for example) or semi-presidential systems (France and the Russian Federation in this instance) have guaranteed the executive the right of initiative and by choosing to deny it to the Council of Minister is fundamentally undemocratic. Due to the Senate of Aurentina's unique procedure, especially in regards to omnibusing, this right of initiative for the executive has to be integrated with the current structure. As a result, this bill wishes to introduce the 'Government Policy omnibus'. Also, such an omnibus would increase governmental efficiency, allowing them to implement their policy more effectively, something highly beneficial to the Senate as a whole, as due to the diversity in terms of political parties, multi-partisanship is highly likely and with that minority governments, meaning that the government will have to work with the opposition more often. This bill also introduces some revisions to the power of legislative queuejumping.
Regarding the Government Policy omnibus
1a. This bill introduces a form of omnibusing, the Government Policy omnibus.
1b. A Government Policy omnibus shall be an omnibus that will be voted on at each voting sessions, along side the current omnibus at vote.
1c. In order to add a bill to the Government Policy omnibus, it must be co-sponsored by the Prime Minister, or the Deputy Prime Minister, if the Prime Minister has chosen to delegate that power.
1d. A bill introduced by the Prime Minister is automatically added to the Government Policy omnibus and can not be removed. A bill introduced by a Minister is also automatically added to the Government Policy omnibus, but may be withdrawn by the Prime Minister, or the Deputy Prime Minister, if the Prime Minister has chosen to delegate that power.
Regarding Legislative Queuejumping
2a. The President's power of legislative queuejumping shall be withdrawn from him and transfers them to the President of the Senate, who is also the Vice President of Aurentina.
2b. The President pro tempore of the Senate to also use this power in the place of the President of the Senate.
2c. This bill allows the Prime Minister to veto a legislative queuejumping motion.
2d. The petition rules (seven signature in favour of a legislative queuejumping motion) shall continue to apply
2e. The President pro tempore, or the President of the Senate, is accountable to the Senate when performing legislative queuejumping and should they do perform it in poor faith, then it is a case to change the President pro tempore. If it's the President of the Senate who performs a motion of legislative queuejumping that has met widespread disapproval, then the Senate may choose to censure him from performing his duty in the Senate, leaving all power to the President pro tempore.
A concern that Maklohi raised was that only one bill could be vote at a time. However this clause was repealed from the Second Constitution of the Senate, so this is perfectly legal.

Section 1 - Purpose and Goals of the bill
The main focus of this bill is to bring about a formal organization and structure, for the trying of criminal and civil court cases. This bill's intent is to give the people yet another tool to fight back against crime and to settle civil disputes without draining much needed police resources from the streets. With the high hopes that justice will be brought to those who dare to disturb the law and it's people.
Section 2 - The Courts
The court system is to be divided up into a Civil and Criminal court systems, to better serve the needs of the people and to bring judgement upon wrongdoers. Said courts will be divided further to provide more direct and specialized service. Included in this section as well, is the provisions for who presides over cases and how rulings are made.
General procedures: Once the case is called forth by the judge, the defence will be asked to plea guilty or not guilty to the charges at hand; the judge will then hear the defense's motion for bail and the prosecution's counter motion. This will be the time in which the prosecution will be able to motion to temporarily revoke passport and travel privilege's of the defense's client for the duration of the trial. Moving forward the jurors will be brought in after the judge make's a decision on the previous motions. Then opening arguments from the defence and then prosecution. After which the prosecution will be able to present evidence and bring in witnesses or other evidence. After which the defence may make it's case and bring in it's witnesses or experts to formulate a case for their client.
When both sides are satisfied that they have made their case and both sides rest, the jury will be asked to deliberate upon the evidence and deliver a verdict. This may proceed for a maximum of 7 days before the jury is declared hung and a retrial must take place. Upon the verdict of Guilty, the judge will then take time to deliberate and hand down sentencing with regards to established limits on the charges before him. If declared not guilty the defense's client may leave the court room after filing his release papers and retrieving any seized items or passport that are legal within law.
Criminal Court
Superior Court - This court is tasked with the job of trying cases that are deemed to be of national importance, and those cases directly related to the senate, or crimes against the nation such as acts of terrorism. This court is overseen by a Superior Court Justice, and a panel of 16 [Sixteen] impartial jurors who will review evidence and pass down their collective verdict.
Municipal Court - This court will be tasked with the handling of everyday cases such as affray, harassment, or other everyday infractions. This court is presided over by a Municipal Judge who makes rulings based on the evidence and testimony presented by arresting officers and legal assistants. A jury of 10 is to be brought in for Felony crimes where the defendant may face large amounts of jail time, crimes such as murder.
Appeals Court - This court is tasked with the responsibility of overseeing the appeals process for criminals seeking to have their sentencing overturned or anything of the likeness, such as reduced sentencing and removal of specific punishments. A panel of 3 [three] judges will preside over appeals cases.
Civil Court
Small Claims Court - This court is tasked with handling cases that involve everyday disputes such as, land ownership, property damage, and refusal of payment. This court is presided over by a single judge who will listen to the prepared arguments of both sides, the plaintiff and defendant.
Business Court - This court will be tasked with hearing cases against business's and corporations such as, discrimination, dangerous work environment, and other damages or violations. This court is presided over by a panel of 5 [five] judges who will pass down their ruling after hearing the cases of the plaintiff and the defendant.
Family Court - This court is tasked with handling legal battles in the cases of: inheritance, divorce, and custody/child care. This court is presided over by a single judge and a review panel of 6 jurors.
Section 3 - Judge Appointments
The MoJ will appoint judges to all positions except for the Superior court and Business court; where an impartial panel must be formed through a candidate selection process overseen by the PM and MoJ as well as the shadow MoJ. Judges should be chosen upon merit and ability to fill the function they were appointed to do.
Section 4 - The Bailiff and Marshal Services
There is a need to protect the courts and to also bring in those requested by the court without drawing on the already strained police numbers. This section will outline and set the directives for the following services.

They are given the task to maintain in building and outer building foot patrols, standing stations in the court room itself and the doorways. The uniform of these officers will be a khaki variable sleeve button up pocketed shirt, dark brown pants with a single gold stripe on the outer of each leg, and brown shoes. Service belt and radio will be supplied. A star badge will be displayed above the left breast pocket.
National Marshal Service
Under the administration of the MoJ, the NMU will be tasked with the recovery of fugitives, high value targets, protection of witnesses, protection of judges and VIPs, and the movement of criminals. they will be armed to meet specific MoJ standards.
Marshals will be allowed to wear a professional attire and their issued service weapons as well as a shield badge that will be mounted in a wallet type holder and hung from a pocket or necklaced chain for clear visibility.
Section 5 - Courtroom Offences
Contempt of Court - When a defendant, member of the audience, jury, or anyone present makes disruptive actions and acts with malice or harmful intent. This is a Contravention and is punishable of a max of 30 days in jail and a maximum fine of £50.
Disruption of Court proceedings - When someone enters a court room in session and makes a distraction or detracts from the proceedings at hand. This is a delict and is punishable by a maximum £250 fine.
Definitions
MoJ - Minister of Justice
Bailiff- Officer responsible for court security
Marshal- Officer responsible for specialized court related duty.
Court Justice- Special term for Superior Court judges.

National Marshal Service
Under the administration of the MoJ, the NMU will be tasked with the recovery of fugitives, high value targets, protection of witnesses, protection of judges and VIPs, and the movement of criminals. they will be armed to meet specific MoJ standards.
Marshals will be allowed to wear a professional attire and their issued service weapons as well as a shield badge that will be mounted in a wallet type holder and hung from a pocket or necklaced chain for clear visibility.
Section 5 - Courtroom Offences
Contempt of Court - When a defendant, member of the audience, jury, or anyone present makes disruptive actions and acts with malice or harmful intent. This is a Contravention and is punishable of a max of 30 days in jail and a maximum fine of £50.
Disruption of Court proceedings - When someone enters a court room in session and makes a distraction or detracts from the proceedings at hand. This is a delict and is punishable by a maximum £250 fine.
Definitions
MoJ - Minister of Justice
Bailiff- Officer responsible for court security
Marshal- Officer responsible for specialized court related duty.
Court Justice- Special term for Superior Court judges.
Hereby passes and immediately enacts the Commonwealth Court Establishment Act.

The Services and Goods Sales Tax (SGST)
Essential Goods and Services, defined as basic groceries, prescription drugs, tuition fees, public transportation fares, housing (both purchases and rent) and medical devices and services shall not be taxed.
Basic Grocery is defined as fresh, frozen, canned and vacuum sealed fruits and vegetables, breakfast cereals, most milk products, fresh meat, poultry, grain products and fish, with further clarity to be affirmed by the Ministry of Commerce.
Prescription drug is defined as a drug prescribed by a licensed physician acting in official capabilities.
Tuition fee is defined as the cost of attending a pre-elementary, elementary, secondary, tertiary or other licensed educational facility.
Public transportation fare is defined as the charged price for using a bus, train, metro, tramway, LRT or minibus owned by a public transportation commission approved by the Transportation Ministry.
Medical service and device is defined as a healthcare-related expenditure or good, to be further defined by the Ministry of Health.
Secondary Goods and Services, defined as foodstuffs not included in "basic groceries" or "noxious products", street clothing, all consumer-targeted forms of gas and oil for commercial and fleet driving, electronics, entertainment devices, media and all other consumer-oriented products not covered by other categories, are taxed at 5% of selling price.
Gas and oil is defined as products obtainable at a standard gas station (petrol, diesel, etc.), natural gas, heating oil and cooking oil.
Street clothing is defined as clothing destined for everyday life.
Electronics are defined as electronic equipment intended for everyday use, most often in entertainment, communications and office productivity, and accessories thereof.
Entertainment devices are defined as machines used for consumer entertainment, and accessories thereof, to be further defined by the Ministry of Telecommunications.
Media is defined as services relating to the consumer entertainment industry, along with all forms of distribution of moving pictures, images, televised series, video, and the storage devices thereof.
Luxury Goods and Services, defined as items not needed for everyday life, such as designer clothing, jewellery, motor vehicles, hotel fees, residential property above the value of £2,000,000 and other products and services deemed so by the Ministry of the Exchequer are to be taxed at 10% of selling price.
Restricted Products, defined as products restricted by drug and firearms control legislation, and accessories thereof.
Tobacco (and products derived thereof) are exempt from the SGST.
