Ok, I'm a definite leftist and I can't really go with this one. Isn't it obvious that they were talking about physical sex, not gender? In addition, would it make sense to equate sex and gender until they're old enough to decide?

Not really.
Boy and girl are gender terms, not sex ones. In our society men are no more likely to be male than be female, and the same for women, and the vast majority choose no gender at all. So we would not be used to gender and sex terms being exchangeable like many in the wider world are.
Also, in our society physical sex has absolutely no importance to anyone but your date and your doctor, so asking if the child is male or female is not a ubiquitous post-birth question like it is in the rest of the world, so our citizens would not be likely to guess that this is what's actually meant.
And that would be coercively assigning a child a gender at birth based on their physical sex, which would be anathema to us.
