I'm getting damn tired of these overactive courts using far more authority than they should have acquired. The very concept of judicial review should be reevaluated Constitutionally and edited so that Courts will not have the authority to make decisions like this. The Courts are becoming as though a legislature of their own. All they have to do is scream "unconstitutional" and they can enforce whatever they please.

I think Mr. Cooper meant "archaic", not "arcane".

Then again, maybe the statute is fortified with magics both powerful and terrible?

That policy came from Clinton, its not that old or obsolescent, he must have meant arcane.

I don't see anything wrong with DADT, people should keep their sex lives to themselves.

If that's what the policy was about, it wouldn't be a problem. The issue is that if someone is found to be gay, DADT requires their discharge.

I firmly disagree. Anyways, this sort of decision should never pass through the judicial branch. The role of the Courts should be less involved in politics. It's getting to the point where you liberals are abusing the system by simply avoiding the legislature, where you'ld never be able to pass your legislation, and simply heading the Courts where you can forge some sort or arbitrary declaration of unconstitutionality for whatever policy you're opposing. This needs to be put to a stop.

The physical policy itself may not be that old, but it's similar to many precedents that have appeared through the ages.

Why are you against this? What bad thing can exactly happen concerning this? The UK military didn't blow-up when they allowed gays to serve openly.

Aside from that, this bullshit about using religion to treat gays like sub-human is unconstitutional, oh and uhhh... its also a violation of equal protection under the law... oh wow it looks like the Constitution is on our side. But it effects the ability to fight of those who are afraid they'll catch teh gay. I personally think anyone who can't support equality for everyone has no business in the military.

A person's sexual orientation has no bearing upon their ability to serve our country. There is no legal, moral, or pragmatic reason for preventing an openly gay person from being a soldier. Considering that the armed forces are always clamoring for more recruits, while this will not completely solve that issue, it will nonetheless alleviate that problem.

One of my soldiers was kicked out under don't ask don't tell.
He was a former eagle scout, and was one of the most technically competent soldiers on my sift.
the policy hurts readiness and security and may have cost lives on the front by removing better qualified soldiers form service.

Exactly. Not only does repealing this prove to be a victory for the ideals of the country, the ban served only to arbitrarily limit our manpower. So repealing it is a pragmatic move as well as a morally sound one.

The two don't often overlap so neatly, I think it's foolish not to jump at the opportunity when they do.

This is horrible. Now one of the few loopholes for dodging a potential draft is closed.
