Problem becomes the far reaching implications. If I take a photo of my family and happen to catch you hanging brain in the background, am I violating your privacy by showing my family to friends? if a photo I take legally isn't my property to do with what I want, that means I'm legally liable for anything I photograph, no matter how innocuous.

If I took all the photos out of your grandma's photo album, how willing would you be to say I hadn't committed a crime since she didn't own them?

There is a VAST difference between showing family pictures and taking pictures from a crime scene. You as part of the family got to make that choice.

The problem here is that while disgusting, taking those pictures isn't a crime. I think it ought to be, but it wasn't. So the resulting lawsuit is basically asserting that legally taking photos in public opens someone up to a lawsuit if they capture something someone objects to.

What we need is a law tailored to these situations, maybe one that prohibits emergency responders from taking non-duty related photographs?
