Please consider the following hypothetical:

You’ve been effectively framed for murder and you’re now on trial.

The evidence against you is largely circumstantial but you get the feeling that the judge and the jury don’t like you.

Your lawyers need to discuss with you, whether or not you should take the stand. If you take the stand, there is a possibility the jury could see that you are in fact innocent and your lawyers could work with you in the examination to tell your side in a more personalized way. However, the prosecution will also get to try and destroy you in cross examination; literally everything you’ve ever said, done, or written is potentially fair game and even if objected to successfully… it’s not like the jury can magically unhear.

Your lawyers advise against it (they think the prosecution will make you look bad over 9-10 days and they’ve seen this backfire a lot). They think it’s best to keep you out of it. You are not necessarily reassured.

The decision is yours.

Do you take the stand? What’s your calculation?

I wouldn’t take the stand. 9-10 days of questioning from both sides? I don’t have the endurance for that. Also, I don’t have very thick skin and the prosecution will probably make me annoyed really fast. I’ll probably get manipulated into a very bad space.

No. Taking the stand is rarely advantageous, especially not in a murder trial. Were I charged with something like drugs instead then maybe I'd be more inclined to take the stand and push for jury nullification, but I can't see any circumstance in which the jury is going to think I'm guilty of a murder but acquit me, unless the victim is a child molester or some other kind of scumbag.

I'm very proud of the charisma I've built up over almost 30 years of life, I went from an awkward and creepy teenager to a pretty charming dude all things considered, but you have to be top fucking tier to survive cross and I'm not there.

I dunno, maybe if you have a clean file and nothing controversial in your past.

As for me, there’s a tons of potentially prejudicial nonsense (nothing strictly in the criminal records department per say but other unclean mojo) they could grill me on and that’s before they even begin to access my internet usage history, my complete artworks and my collections. If they find a number of old acquaintances of mine things can also get messy really fast.

Sure they’ll use this anyways (some of it will be excluded but probably not all of it) but it’s best if I don’t have to try to answer questions about it while maintaining my cool over a long period. I think the temptation on my part to get snappy, overly defensive, and to try to “get clever” and bait back would be too high.

Unless this is the Ace Attorney Universe. Then you not only have to prove you didn't commit the crime but also provide the evidence of who did, or the Judge will push for a guilty plea to save time on paperwork.

It wouldn’t have gone to trial unless the DA or whoever approved it felt that in terms of probabilities they had much higher than 50 percent to nail you.

Generally in something like this you do what your lawyer advises

Most of the time the lawyer will advise an innocent person to take the stand.

The prosecution Generally is not allowed to go fishing about other crimes, or bring up things unrelated to the trial at hand.
