Garland seemed pretty clear during his confirmation hearing at least:

Asked by Sen. Sheldon Whitehouse, D-R.I., whether he would rule out investigating funders, organizers, ringleaders, and aiders or abettors of the [January 6] attack, Garland said he wouldn’t.

“We begin with the people on the ground and we work our way up to those who are involved and further involved and we will pursue these leads, wherever they take us,” Garland said.

In this case we are talking about civil suits against Trump and Barr, the latter in his capacity as AG which makes Justice a party. Justice seems to be arguing the President's security bubble overrules the Consitutional rights of peaceful protesters in all instances; as the ACLU points out the logical conclusion would be that the National Guard could have massacred everyone in Lafayette Square so that Trump could step over their corpses in order to get a picture of himself standing in front of a church where he was neither invited nor welcome holding an upside-down Bible like a soiled diaper. Their secondary argument that nothing of the kind was likely to happen in this administration is more an argument in favor of letting the civil suits against Trump and Barr proceed, which could help ensure nothing of the kind would be likely to happen should the Republican Big Liars capture the Oval Office in future.
