Fowler says he didn't make an assumption but an "evaluation" that the car was running based on seeing "water dripping from the tail pipe."

Um, that doesn't mean anything.
It's true catalytic converters make cars drip a little water in a lot cases while running, but the act of shutting a vehicle off also causes water to drip, as the hot exhaust gases cool down and the water vapor contained therein condenses from the temperature change.

Well, it would have been suicide to not do it. He's just on a too weak position to survive being grilled by the prosecutors.

Defense did a fairly decent job impeaching some of the prosecution's witnesses but not others, and didn't seem to really have a coherent case theory.
I'd say the odds of tagging him on at least 3rd degree murder are good.

From what I've read literally only one police officer in American history has ever received the death penalty in regards to their on duty behavior, and that was in 1910.
