California Gov. Gavin Newsom signs bill which prohibits public universities from deadnaming trans and nonbinary students on diplomas or academic records

Governor Gavin Newsom signed a bill that will bring benefits to transgender public college students in California, while a second piece of legislation that would benefit sex workers has been delayed until January.

As the Bay Area Reporter reported online October 6, Newsom signed Assembly Bill 245, which prohibits public universities from deadnaming trans and nonbinary students — that is using their former names they were given based on the sex they were assigned at birth — on their diplomas and academic records. Newsom's action is in marked contrast to what has occurred in numerous statehouses across the country this legislative session, where lawmakers have adopted legislation targeting their state's transgender community, particularly trans youth.

Its author, outgoing Assemblyman David Chiu (D-San Francisco), had revived the legislation this year after he had to shelve it in 2020 in light of the COVID-19 pandemic upending the Legislature's workload.

It builds on an earlier bill authored by Chiu that became law and requires public K-12 schools in the state to update the records for transgender and nonbinary students so that they match their legal name and gender identity.

AB 245, titled "Affirming Transgender and Nonbinary Student's Names in College," requires California's community colleges and public universities to use current students' lived names on their transcripts, diplomas, and other documents as of January 1, when the bill takes effect. Currently enrolled transgender and nonbinary students would be able to use their lived names even if they have not legally changed their names.

Former students who already graduated or left campus for whatever reason could petition their alma mater to upgrade their name and gender on their academic records. But they would have to do so legally, as the bill requires they show a government-issued document like a driver's license, birth certificate, or passport bearing their current name and gender.

"A diploma represents years of hard work. Students should be able to celebrate their academic achievements without fear of being deadnamed," stated Chiu, set to become San Francisco's first Asian American city attorney November 1. "Deadnaming a student on a diploma can put up barriers to future employment and out a person in an unsafe situation. I'm grateful the governor signed this bill to ensure we are protecting and lifting up all of our students in California."

Last November, the UC system had released a new policy on gender identity that all of its campuses were to implement by December 31, 2023. It included using students' lived names on their academic records.

City College of San Francisco implemented a chosen name system for its trans and nonbinary students and staff last year. Under its gender diversity and inclusion policy the use of chosen names is mandatory except for certain financial and legal documents.

"College students make tremendous sacrifices and put in years of hard work earning their degrees, and the outcome of all that dedication should be a diploma with the name of their choice. In signing AB 245, Governor Newsom is ensuring that California continues to lead the way in supporting trans and nonbinary students in our schools," said gay City College board vice president Tom Temprano, who had his colleagues pass a resolution this spring in support of Chiu's bill.

South Korean court ruled Thursday that the military unlawfully discriminated against transgender soldier Byun Hui-su by discharging her for undergoing gender reassignment surgery

A South Korean court ruled Thursday that the military unlawfully discriminated against the country's first known transgender soldier by discharging her for undergoing gender reassignment surgery, in a landmark verdict that came seven months after she was found dead at her home.

Activist groups said the decision by the Daejeon District Court advances the rights of sexual minorities but also described it as delayed justice for Byun Hui-su, who had protested the army's decision to force her out.

South Korea prohibits transgender people from joining the military but has no specific laws on what to do with those who have sex reassignment operations during their time in service. Byun, who had been a staff sergeant and tank driver, was discharged in January 2020 after the army concluded that her operation could be a reason for dismissal. The army then cited a law that allows the military to discharge personnel with physical or mental disability if those problems didn't result from combat or in the line of duty, and said Byun's loss of male genitals amounted to a disability.

Byun, who said she had sex reassignment surgery in Thailand in November 2019 after suffering depression over her sexual identity, expressed a desire to continue serving, but a military panel rejected her appeal. She filed a lawsuit against the military in August 2020, and her relatives inherited the suit after she was found dead at her home in the central city of Cheongju in March this year.

The Daejeon court said the army's decision to discharge Byun couldn't be legally justified because it was based on an assertion that she was male. The court pointed out that the army already knew Byun had applied to the Cheongju District Court to change her legal status as a woman before it decided to discharge her. The Cheongju court granted Byun's request weeks after she was discharged.

"In deciding whether Byun Hui-su's case could be interpreted as a physical and mental disability as defined by the military personnel law, it's obvious that the decision should have been based on the premise that (Byun) was a woman following gender reassignment," the Daejeon court said in a statement explaining its ruling. "Therefore, the (army's) conclusion that Byun Hui-su's loss of (her male genitals) amounted to physical and mental disability, which was based on the premise that Byun Hui-su was male even after gender reassignment surgery, is undoubtedly illegal and should be canceled," it said. [...] In a text message sent to reporters, the army said it respects the court's ruling and will hold "comprehensive" discussions on how to respond. The army said it hasn't decided whether to appeal.

At the time of Byun's death, the Defense Ministry expressed condolences but said the military had no ongoing discussions about allowing transgender people to serve.

The Texas Department of Family and Protective Services (DFPS) quietly removed information intended to help prevent LGBTQ youth suicide from one of its websites after Gov. Greg Abbott (R) was criticized by a primary opponent for “promoting transgender sexual policies to Texas youth.”

The site for Texas Youth Connection, part of DFPS, used to have a page called “Gender Identity and Sexual Orientation” that had links to various LGBTQ youth resources, including a suicide prevention hotline and educational materials. In August, Don Huffines, who is challenging Abbott in the Republican primary, criticized the site in a video posted to Twitter.

“Governor Abbott’s political appointees that are running the Department of Family and Protective Services have put out and has been on their website some very disturbing information,” Huffines said in the video. “They are promoting transgender sexual policies to our- to Texas youth!”

He read out what each of the letters in LGBTQ means and said: “This is Texas! These are not Texas values. These are not Republican Party values. But these are obviously Greg Abbott’s values.”

“It’s offensive to see Greg Abbott use our tax dollars to advocate for transgender ideology,” he tweeted. The Houston Chronicle obtained internal DFPS emails that show that the video disturbed its leadership. Within minutes of the video being posted, media relations director Marissa Gonzales sent an email to DFPS spokesperson Patrick Crimmins with the subject “Don Huffines video accusing Gov/DFPS of pushing liberal transgender agenda.”

“FYI. This is starting to blow up on Twitter,” she wrote.

Crimmins then emailed the DFPS’s website director and told him: “Please note we may need to take that page down, or somehow revise content.”

Despite the fact that the site was providing information that could save lives, it was taken down to advance Abbott’s political career and replaced with a message that said that it “has been temporarily disabled for a comprehensive review of its content.” Now the page is completely offline.

And why should it matter? How does Superman being bi detract from the story in any way?

This is nonetheless the closest equivalent to a general LGBT issues thread that I can find on here, else I'd have to risk making a new topic or post in a even more out of context one if I'm to opine on this recent event. This is trying to make Superman bi for the sake of it. Just because its cool or supposedly trendy for liberal media. In the old days when he originated, it wasn't even a thought to be doing this.

I guarantee this wouldn't be a problem if Jon, as the next Superman, was dating a female friend, even if he continued to be canonically bisexual. It's just that because he is dating a male friend, this is an issue for... some reason?

Also, this isn't really new, as far as I'm aware. It's just that now Jon is being Superman.

Incidentally, there's a transwoman in a romance plot in The Immortal Hulk. I don't think she ended up getting dosed with gamma radiation, but she's a main character (eventually).

And Xavin in Runaways is an explicitly nonbinary shapeshifting alien (though, I believe, the TV show adaptation forced them into just being female... and most of Xavin's appearances are based on a "are you really female or really male?" thing... and Xavin was put on a bus for, like thirteen years).

I don't read DC, but I imagine they have trans (as opposed to bisexual) characters, too. And Marvel probably has more other than just those two (one of whose names I can't remember, anyway).

I had to know if there were siblings so I read the first two, I think, issues. Even if Jon was straight as an arrow, there is nothing in that comic that a conservative reader will like. Unless they're really into Wonder Woman larping as a midwife.
