Int. Criminal Court investigates Israel/Palestine War Crimes

[International Criminal Court (ICC) prosecutor Fatou Bensouda on Wednesday announced her intention to open an investigation into crimes allegedly committed in the Palestinian territories since 2014.

Why it matters: The investigation is expected to consider possible war crimes by Israel and Hamas during the 2014 war in Gaza, as well as the construction of West Bank settlements by Israel. It could sharply increase tensions between Israel, which fiercely opposes the probe, and Palestinian leaders, who requested it.

The investigation will also force the Biden administration to wade into the Israel-Palestine conflict, which had been very low on its foreign policy priorities list.
Israel is very concerned that any investigation could lead to international arrest warrants against Israeli officials and military officers and could boost BDS (boycott, divestment and sanctions) campaigns against Israel.
The latest: The Palestinian foreign ministry welcomed the decision as an opportunity for justice and accountability and called for a swift investigation.

Netanyahu called the investigation an "attack" on Israel and vowed to "fight for the truth."
"The biased International Criminal Court took a hypocritical and anti-Semitic decision," he said. "The court doesn't say anything about the real war crimes Iran and Syria commit."
What's next: Bensouda said the priorities of the investigation will be determined in the coming weeks, taking into consideration coronavirus-related operational challenges, the limited resources of her office and the current heavy workload.

Bensouda made this decision in her final months in office, and it's unclear whether she coordinated the move with her successor.
What she's saying: “Any investigation undertaken by the Office will be conducted independently, impartially and objectively, without fear or favor," Bensouda said in a statement.

She added that the investigation will take time and be grounded in facts and the law. "My office will take the same principled, non-partisan approach that it has adopted in all situations over which its jurisdiction is seized. We have no agenda other than to meet our statutory duties under the Rome Statute with professional integrity," she said.
Flashback: The Trump administration joined Israel in mounting a vigorous campaign in 2019 to block a potential investigation, including by placing sanctions on Bensouda and other court officials.

ICC judges cleared the way for a potential investigation last month when they ruled that the court has jurisdiction in the West Bank and Gaza. (Israel isn't a party to the Rome Statute, which set the court's mandate, but the Palestinian territories are.)
Behind the scenes: Israel had asked dozens of allies to convey a "discreet message" to urge Bensouda not to move forward with the probe, as Axios reported two weeks ago. Israeli Prime Minister Netanyahu also asked President Biden to keep U.S. sanctions on the court in place as leverage.


The International Criminal Court prosecutor said on Wednesday her office will open a formal investigation into war crimes in the Palestinian Territories which will examine both sides in the conflict.

The decision comes after the court ruled on Feb. 5 that it has jurisdiction in the case, a move which prompted swift rejection from Washington and Jerusalem. The Palestinian Authority welcomed the ruling.

"The decision to open an investigation followed a painstaking preliminary examination undertaken by my office that lasted close to five years," outgoing Prosecutor Fatou Bensouda said in a statement.

"In the end, our central concern must be for the victims of crimes, both Palestinian and Israeli, arising from the long cycle of violence and insecurity that has caused deep suffering and despair on all sides," Bensouda said.

"My office will take the same principled, non-partisan, approach that it has adopted in all situations over which its jurisdiction is seized."

Bensouda, who will be replaced by British prosecutor Karim Khan on June 16, said in December 2019 that "war crimes have been or are being committed in the West Bank, including East Jerusalem, and the Gaza Strip". She named both the Israeli Defense Forces and armed Palestinian groups such as Hamas as possible perpetrators.

The next step will be to determine whether Israel or Palestinian authorities have investigations themselves and to assess those.

There was no immediate comment from Israeli Prime Minister Benjamin Netanyahu. When the court ruled on jurisdiction, he said: "When the ICC investigates Israel for fake war crimes, this is pure antisemitism."

The Palestinian Authority welcomed the prosecutor's investigation.

It is "a long-awaited step that serves Palestine’s tireless pursuit of justice and accountability, which are indispensable pillars of the peace the Palestinian people seek and deserve", the PA foreign ministry said in a statement.


Tl;dr: Despite the best attempts of Benjamin Netanyahu and the Trump administration to prevent it, the International Criminal Court will be opening an investigation into war crimes committed in the Palestinian Territories by both sides.

Personally, I'm all for this, it'll help bring some measure of accountability-and considering how hard some people fought to stop it from getting off the ground, it doesn't appear to be entirely unfounded

But what do you think, NSG? Am I too optimistic? Will this go anywhere? Will it help bring accountability to the region, or just inflame things further? And based on the vulnerabilities of the ICC that we see here, how do we develop a method to hold bad actors accountable when their own state is incentivized not to?

Here's hoping it will be less of a kangeroo court than the Russell Tribunal. It's a good start that this is presumably an actual court rather than a fancy name for a protest platform.

The only way really is that when states/leaders who act extremly bad are punished or shunned by the rest of the international community, usually that means the US and their vassals. But given that US hegemony isnt existing anymore they can as well turn to other powers if the US puts them on the naughty list.

So without consensus of the main powers that be theres little chance wrongdoers are going to be punished.

The ICC is a relic of the 1990s when things seemed as if supranational institutions could be established that could in turn create an international (intrinsically neo-liberal btw) order beyond the powers. But this is intrinsically dependent on the will of the powers that be to enforce that. The US werent part of the ICC to begin with also. So basically same story as with the League of Nations.

To paraphrase my favourite TV show that I never watched, never open an inquiry unless you know in advance what its findings will be.

Considering that Palestine seems all for it and the Israelis are trying to block it, I can already imagine what the results of the investigation will be. Whether there will be any substantive truth to that conclusion... well, that’s another matter.

Whether anyone influential will care what the conclusions will be is also another matter.

Israel withdrew its signature to the Rome Statute of the International Criminal Court because the ICC wanted to start treating "the transfer of parts of the civilian population of an occupying power into occupied territory" as a war crime.

The ICC can't do anything to Israel if Israel doesn't agree to it and no matter what side you're on no one will think the trial was "Fair".

The ICC can't enforce their ruling, so what I am interested in is the full record of both sides' war crimes, in public. At least that will dispel propaganda on both sides.

As long as it is truly looking at war crimes by both sides, and not just accusing Israel or just accusing Palestine, I’m glad.

The UN usually is too anti-Israel, while the US is usually too anti-Palestine, so as long as they make sure to treat both sides equally with no bias then its good.

The ICC should establish a record of the decades of atrocities committed against the Palestinians and who is responsible for them. Not having the perps in custody a la Nuremberg, what may come of that is less certain (but iirc wasn't it Israel that established the standard for abducting war criminals and putting them on trial?)
