Not true. An oath is not required to become president. The inauguration ran late in 2008 and Obama become president at noon.

The word can is not the same as the word must. It gives people choices. Of course, government agencies should avoid discrimination and have a don't ask, don't tell policy in regards to dealing with homosexual relations. People should not be asked about their sexual orientation within government agencies.
