Also, ironically a lot of what they rally against are progressive ideas, which liberals aren't a big fan of. But that would mean taking nuance and understanding of the other side into account.

Because nothing in the law says it is illegal. The law says the president nominates, the senate confirms.
It can be done at any time, there is no law saying it cannot be done near an election.

You can disagree with it. But there are no good grounds to say it is illegal.
