So is 13 Justices after one party takes the White House and Senate. Better order those extra chairs for teh Supreme Court chambers today.

You're not wrong but that would definitely not be prudent and would only exacerbate the situation further

Well certainly the U.S. will eventually end. And at the rate it's going, hopefully sooner rather than later.

In a sick way I’d like to see 269-269 EC and a 50-50 senate for maximum chaos

We didn't until it actually happened. At the time I was extremely dubious that the "advise and consent" power of the Senate extended beyond "consent or refuse" to "refuse to even consider" and I still find that a bit baffling.

[The president] shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States . . . . [U.S. Constitution, Article II, section 2, clause 2]

Note that the President does not just nominate but ALSO APPOINT the SC Justices. Obama was denied the opportunity to play his constitutional role, and shouldn't "the Senate" have to give some good reason to do that? And if "the Senate" did give a reason, claiming precedent of other appointments over a span of decades, why does that reason not apply right now?

I imagine your side are overjoyed at Barrett being an avowed literalist. Hope then, that it doesn't come back to bite you in the ass when you realize that other parts of the Constitution can be interpreted literally, besides the Second Amendment.

You might want to think about ...

Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized
.

Old fashioned discretion deters me from naming the place to be searched, but if the "person or things to be seized" is a fetus, anti-abortionists might have a problem!

Consent of the senate is the deciding factor here. The senate did not consent to the nomination, therefore Obama could not fill the seat with his nominee. Also, the 4th Amendment has nothing to do with abortion and to argue such is lunacy.

Well I started cringing when trump started interrupting and debating at the moderator. I'd call it a Biden victory. Possibly the biggest mistake he made was channeling his inner palatine and saying "I am the Democratic party." It set him up for the moderator to skewer him with why he hasn't quelled the riots in Portland Oregon by calling the local democratic leaders and demand they get it under control.

You're right. I think there is general shock and alarm to discover that both candidates can still stand up for an hour and a half.

I didn't see much sign of mental decay either, to be honest. Trump still has a short attention span, and Biden still trips over his tongue.

That's clearly not true, he's shilling for Biden.
