Except that Free Speech does not mean free of consequences. If someone says something that their employer doesn't like, they can be fired. If they say something their friends don't like, they can be unfriended. If they say something that a social networking website doesn't like, they can have their account deleted.

Just because someone has the right to say something doesn't mean that they won't get hit with consequences. Even if there was an anarchist society if someone says something that a group of people doesn't like then they will be stoned, hung, etc by a mob.

Point one - FDR's day of infamy speech advocated for extreme violence against the Japanese.

Point two - How does one prove the intent of a liar?

Did the day of infamy speech advocate harming US citizens of Japanese descent, or just for fighting against Japan as a nation?

Obviously the latter, even if FDR was more than happy to send Japanese to internment camps, the speech itself was against the Empire of Japan.

freedom of speech is good, but things like death threats and hate speech shouldn't be allowed, and misinformation should be marked as such.

But it did advocate for violence; the poster did not say only advocating violence against US citizens should be prohibited.

What is hate speech? What if someone says 'I hate Trump' or 'I hate Biden' and someone is offended? This would technically be hate speech because the word 'hate' is used. If hate speech is banned, then we have to even ban speech which criticizes because that would also be offensive to someone.

True. The problem with this sort of thing is they can be easily exploited into 'anything I don't like', and while it doesn't necessarily happen all the time, the opportunity still lies.

That being said, I understand the intent of some of those that want to - what I'd say is that there are better ways of tackling the problem than simply making more laws.

Hate speech is a communication that carries no meaning other than the expression of hatred for some group, especially in circumstances in which the communication is likely to provoke violence. (USLegal.com)

So, if I say all Trump supporters are morons who do not deserve to live, that is hate speech. Should my saying that get me arrested?

Silly Kowani, if they learn the definition of the words they use, how can they fearmonger against basic common decency?

My point is that the term hate speech is overly broad, and if hate speech is to be banned then there would have to be some penalty for its usage, be that jail or fine.
