The letter of the law and the spirit of the law are not the same thing. And simply because there is no documentation of specific reasoning violating EEO/EEOA does not mean discrimination isn't an issue and not taking place. Most EEO/EEOA claims are very hard to prove. But that doesn't mean that there is no discrimination happening, nor that it should not be addressed at some level.
The Dept of Ed, headed by someone who has the general competency of a wet sponge is rushing in there as part of a culture war. They are coming in with a hammer because they want Princeton to back-peddle on its statements. Because nothing is going to state "We didn't accept [X] because [X] was [Y] ethnicity".
This is basically painted as "AH-HA! Princeton has to show where they did not enroll/hire someone documented because of their race or they are lying!".... and frankly such a painting is made by someone who is, and I will be blunt about it.... extremely ignorant and naive of what actually is going on.... but then bending on the ranting on naive ignorant people is what this entire Administration is all about.
