Man dies after Alameda (CA) police kneel on him for 5 minutes

Body cam footage released Tuesday shows California police officers kneeling on a handcuffed man until he was unresponsive, a death the department previously blamed on a “physical altercation.”

Mario Gonzalez, 26, died on April 19, just a day before Derek Chauvin was convicted of murdering George Floyd, after the Alameda Police Department was called to a local park about a drunk man and possible thefts. Police initially described the incident as a “scuffle” and said that Gonzalez suffered a “medical emergency.”

In nearly hour-long footage released publicly Tuesday after pleas from the family, Gonzalez begged officers not to do “this” before losing consciousness. After the 911 calls, police confronted Gonzalez, who appears impaired and is standing alone in the park with two baskets filled with bottles next to him. They ask him for identification, which he does not have, and then eventually move to handcuff him behind his back. Gonzalez resists and tries to move his hands to the front of his body before the officers eventually get him on the ground, face down in mulch.

“What are we going to do?” one officer asks. “Just keep him pinned down?”

As Gonzalez begins whimpering and crying, the officers tell him to keep talking, asking him for his birthday.

“Please don’t do this,” Gonzalez says as the footage pans to an officer with his knee and elbow on Gonzalez’s back.

One officer asks if they should roll Gonzalez on his side, but another says he doesn’t “want to lose what I’ve got.”

“We have no weight on his chest,” an officer says.

Seconds later, Gonzalez loses consciousness

Officers checked for a pulse, finding none, then began chest compressions. One told responding paramedics that he administered Narcan, used to reverse overdoses.

Gonzalez was eventually declared dead at the hospital.

“The City of Alameda is committed to full transparency and accountability in the aftermath of Mr. Gonzalez’s death,” officials said in a statement on the city’s website.

The Alameda County Sheriff’s Department and Alameda County District Attorney’s Office and an independent, outside party have all launched their own investigations. The three officers, identified Tuesday as Eric McKinley, Cameron Leahy and James Fisher, have been placed on administrative leave.

Gonzalez’s brother, Gerardo, claimed the officers “murdered” his brother.

“My mother was heartbroken to see Mario’s last moment. She gave birth to him, her firstborn, raised him, and now has to bury him. It was painful to watch the violence and disregard for his humanity,” he said outside the police station Tuesday, according to the Mercury News.

“The footage shows officers on top of Mario while he was face down on the ground. They had their weight on his head and his back. He was complying and they continued to pin him down with their weight. Everything we saw in that video was unnecessary and unprofessional. And it took a minuscule event and made it fatal.”

How often does it need to be repeated that the weight of the individual being detained can be enough to stop them from getting enough oxygen when in that position on the ground?

Based on what we saw during the protests last year, both of these claims have a high likelihood of being untrue.

Garret Rolfe, Atlanta police officer fired after fatally shooting Rayshard Brooks in a Wendy's parking lot last year has been reinstated by Atlanta’s Civil Service Board over improper procedure

The Atlanta police officer who was fired after fatally shooting a Black man in a Wendy's parking lot last year has been reinstated by Atlanta's Civil Service Board.

Rayshard Brooks, a 27-year-old husband, father and stepfather, was running away when he was shot by officer Garrett Rolfe on June 12, Fulton County District Attorney Paul Howard Jr. said at the time. Rolfe, a seven-year veteran of the department, was fired and charged with felony murder. Rolfe appealed his firing and Atlanta's Civil Service Board ruled on Wednesday that "due to the City's failure to comply with several provisions of the Code and the information received during witnesses' testimony [Rolfe] was not afforded his right to due process."

Lance LoRusso, who represented Rolfe in his appeal, told The Atlanta Journal Constitution that Rolfe will "essentially be on administrative leave pending the outcome of the charges."

The Board noted that Rolfe did not receive a 10-day notice of his termination, which took effect June 14. According to the city's code, "An employee against whom an adverse action is to be taken shall be given a written notice of proposed adverse action, signed by the appointing authority or designee, at least ten working days prior to the effective date of the proposed adverse action."

The Civil Service Board found that the city's actions "were not compliant with the ten days prior notice period as required by the Code," as a notice of proposed adverse action and notice of final adverse action were issued to his union representative on June 13.

LoRusso applauded the ruling.

"We are very pleased at this action and consider it the first step in the total vindication of Officer Garrett Rolfe," he said in a statement.

L. Chris Stewart and Justin Miller, attorneys for the Brooks family, said at a press conference Wednesday that the family feels "disappointment and confusion."

"It is disappointing to the family, but what is more important is the questions we have now. We all heard the mayor and the former chief of police come before the world and announce they were firing the officers and justice will come," Stewart said. "We find it mind-boggling our elected officials and former chief weren't aware of the proper procedure to fire an officer."

Stewart slammed the faulty police procedure as an "error that cannot happen."

Miller added: "Now this person is back on the streets. That hurts. It seems to the family as if no one cares about the life of their loved one."

Miller also said he intends to find out whether the city still intends to terminate Rolfe, using proper procedures, "because that's what should have happened in the first place." The mayor's office said Rolfe will remain on administrative leave while his "criminal charges related to this incident" are resolved.

"In light of the CSB's rulings, APD will conduct an assessment to determine if additional investigative actions are needed," the mayor's office said in a statement to ABC News.

Following the ruling, Mayor Keisha Lance Bottoms said the decision to terminate Rolfe "was the right thing to do."

"Had immediate action not been taken, I firmly believe that the public safety crisis we experienced during that time would have been significantly worse," she said in a statement.
