Reckless endangerment is a crime consisting of acts that create a substantial risk of serious physical injury to another person. Why not charge everyone with that who doesn't maintain six feet distance at the supermarket? Should everyone carry a tape measure at all times?

It was not, actually. Whilst scalping existed in Europe up until the High Medieval Period, it had disappeared by the time of European colonisation. There are pre-Columbian remains that have been found with evidence of having been scalped. It is one of those inventions that seems to pop up in other cultures across the globe independently. Perhaps as an evolution of headhunting!
