Except they are, by saying they are refusing to enforce a law they're saying they are going to ignore a law.
Just like several officers in New York have.
And you know why they are allowed to declare themselves above the law?
Because the government itself doesn't really care about enforcing the law either.
They aren't going to go into a small town and arrest and remove everyone for not bowing to their will because the political blowback will be far greater than whatever gain they would have.
Because for the most part them not following a pointless political law hurts no one, all it does it hurts the egos of the people in the Capitol. As long as they aren't actively doing something oppressive, they aren't going to remove a local government. Unless the local government does something really immoral or illegal that shows up on the news, for the most part state governments know better than to try and micromanage every single county and city in the state.
No one is above the law
