Corporal Punishment

First topic on Nationstates. Let's see how this goes.

Ok, I want to ask you guys, what would you think about applying corporal punishment in the courtroom?

I don't know a lot about legal stuff and all that, but it seems like it would be a good idea on how to save money and still get the job done at the same time. If we could spank some of the criminals and send them on their way, that would save us a lot of money compared to keeping him in jail. Hell, it might even be more effective, but I'm not sure about that.

What do ya'll think?

Well I don't know about the exact punishments for the exact crime or anything like that... it's more of a general concept at this point.

I was thinking something very simple, just having the bailiff in the courtroom carry out the sentence.

Where would you draw the line around which offenses can be solved with a good ''spank'' and which can't be?

A rapist, for example. Good spanking or jail time?

Murderer. Spank or jail?

I'm not sure where the line would be drawn. That's for more intelligent people than me, but since rapists and murderers are pretty sure to still be a threat to society, I would say jail, or some combination of both.

I wouldn't go that far. You're asking a forum of unknowns to handle this. And yet, you yourself have no idea what should be done. Or do you?

Well i got an idea. Those with college/university degrees should be exempt from pyhscial punishment, and those with out should be okayed for caning biching and flogging.

so... a college student is not safe from caning and flogging until AFTER he graduates?

I don't consider 'hit people with a stick' to be a particularly intelligent way of operating the justice system.

Amusing, yes, but not very civilised.

I'm a bit disturbed at being the only 'no' vote...

Actually, there's an excellent system in place already that could address this.

The justice system tends to recognize the difference in severity of different crimes, and categorizes some as felonies and others as misdemeanors (or tort violations, etc). As is, misdemeanors tend to rate fines while felonies rate prison time.

So, if a system of corporal punishment WAS implemented, it wouldn't be difficult to limit it solely to minor crimes and misdemeanors, and reserve full-scale jail time for felonies, like murder, rape, grand theft, etc.


That being said, I personally wouldn't support corporal punishment as part of the legal system, because I don't actually think it would be enough of a deterrent.

This just paves the way for real injustice! Who determines what is minor? Minor might end up meaning being poked with hot cattle prods!

No, I don't know. I want to know what you think. I know my own opinion on this subject. But what's yours? You think corporal punishment is ok? You seem to do. You drew a line? Yes, minor offenses. I would like to know why you think corporal punishment is ok. Don't speak from the maintenance of jails perspective. Why you, Domminus, think it's ok to punish the body for crimes?

How would having a small number of people opt for corporal punishment instead of very short jail sentences save the justice system any significant amount of time and money?

Then what is effectively happening is society is endorsing the idea that a bit of a hiding is the proper response to minor crimes.

Suddenly there's a spike in assaults. Shock horror.
