First the "3 equal branches" is a myth. Congress was always supreme, which is why it has the longest part and first part of the constitution. Congress has the power to make laws, impeach and convict anyone in the federal government, and is the only branch of the federal government that can have part in amending the constitution.

They only added the other 2 branches because they felt the need to. The president was simply added because the country needed an executive that could enforce the laws and the veto power is by far the strongest but even that is easily overridden by congress. The President also can't appoint anyone without the consent of congress. The Executive is very reigned in because they feared a dictator.

The constitution gave congress the instructions on how to create the judiciary but it was the first congress that actually established it. Had they not passed any judiciary acts no federal courts would exist today.

The point of the bill of rights was to protect citizens from the federal government. Even without judicial review, the courts could still protect citizens from abuses of the constitution. If congress passes an unconstitutional law, on appeal of ones conviction their conviction would be overturned for violating their rights.

So basically a law would be in place and up to the state to enforce or not, just the enforcement via the federal government would be nullified though appeals.

You are definitely smart enough to be a cop.

He did get one thing right, the judiciary act of 1789 in which this act established the 3 part judicial court system; district and circuit, etc. and divided the country into districts and set the number of supreme court judges, one chief justice (as required by the constitution) and 5 associate judges and gave the supreme court the original jurisdiction provided for in the constitution.

But bathtubs don't give us a flimsy pretext to become the Stasi!

Alito "you can't ban guns that are nationally in common use"

Reverse Uno card.

East Cost "Any firearm that can be modified to fire automatic rounds are banned and all other firearms that have interchangeable parts with the modifiable ones therein."

Virtually every firearm made in the past 100 years that isn't a pump or bolt action is easily modified to fire full auto, thus your new law has already failed the test.

Then only apply it to long guns since a fully automatic handgun would be ad accurate as shooting blind.

Swimming pools and bicycles as well. Might as well just require parents to wrap their lil crotch gremlins in bubble wrap and round off every sharp corner in the world.

Did you just flat-out ignore everything WRA said about modern firearms failing the test?

No I didn't ignore it, I dare Alito to rule owning automatic weapons are a right I fucking dare him to.

He wont he's accept that we need simply require an aditional step other than pulling the trigger to make the gun fire.

And that has what to do with you ignoring what WRA said about your proposal to ban modern firearms violating the common use standard?

There is also this.
Motion To Dismiss In ATF Firearms Case Claiming Bruen Makes NFA Unconstitutional
USA – -(AmmoLand.com)- Matt Hoover’s (AKA CRS Firearms) legal team filed a motion to dismiss his case, citing the recent Bruen Supreme Court decision claiming that it confirms the National Firearms Act of 1934 (NFA) is unconstitutional.

The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) arrested Hoover this past January, charging the YouTuber with conspiracy to violate the NFA. The ATF claims that Hoover took money to advertise the “Autokey Card.” The Autokey card is a metal card with an outline of a lightning link drawn on it. A lightning link is used to transform a semi-automatic AR-15 into a machine gun. Under the NFA, any device that turns a firearm into a machine gun is considered a machine gun...

Now granted this is about that autokey card and the shaky ground the atf charged him...

It is, because those firearms are in common use. And because they're firearms in common use, they're protected by the 2nd Amendment.

They aren't and weren't common use in the east and west cost. His "National common use" was idiotic to say the least, because of course things aren't different region by region or state by state.

This one isn't going to go anywhere. Even under Bruen the NFA more or less passes the constitutional test, at the end of the day it's just a taxation measure.

Hughes is more complicated though, there's not really a lot of ground it can stand on under the new test and decision. It'll take some years before we hear anything on it but I do think getting rid of it is a plausible win; it both goes against the nature of the NFA as a taxation measure (because the ATF isn't accepting forms for machine guns now, even when people pay the tax) and it doesn't really stand under Bruen either with the whole history of the nation thing.

 That's not how this works.
Hell in 2016 the supreme court ruled in caetano v. massachusetts that even stun guns were of common use and at the time the stun gun numbers ranged in the low 100k.
The common use applies to all bearable arms and thusly the 2nd Amendment protections apply.
The common use notion goes all the way back to US v. Miller ruling.

Stag Arms and Colt ARs were popular here in CT, since they were made here in CT. I was actually surprised the first time I went to the public range to see how many people were shooting ARs and AKs.

And who says I can't use my AR? It's legally registered, as are its 30 round standard capacity magazines. I go to the public range from time to time in order to work on my marksmanship.
