I'm guessing because IM wanted to mention that fairies exist.

The fairies formed an alliance with the kingdoms and the Order.
Annie did not see the fairies as people (which was a fairly common point of view for the time period) and ordered her troops to systematically kill them on sight.
Up to that point, the fairies had been a third side in the war or else had opted to stay out of the war (there are many tribes).
...
Annie's policy with regards to non-magics was more complicated. She used terror tactics to try to intimidate the population from time to time and sometimes would use her magic in attacks that resembled modern day carpet bombing (and resulted in the deaths of millions of civilians).
However, her goal was never to annihilate all non-magic users. She only wanted to replace the non magical monarchies with a magical one.

So they can form alliances but they aren't people...?

Essentially, yes, making Witch Hitler a literal Hitler
there was a kill-fairies-on-sight policy ordered during the war
however, neither side (not even the Alliance) considered this a war crime because the laws of quarter and other protections only applied to humans (non magics and magic users)
you'll notice that this is why in the OP it doesn't mention "genocide" only that she's convicted of mass murder and war crimes (those refer to her destruction of the cities and towns and indiscriminate targeting of civilians)
her attacks on the fairies are viewed as genocide and a breach of war conduct by the fairies, but not by the other factions of the Alliance
the court did not sentence her for that

Still Genocide, no matter how you twist it and say "well, the other side didn't think it was genocide"

it would only have been considered genocide (for the morals of the time period) if she had decided to systematically wipe out all non magic users
this was a policy she avoided (although she was willing to kill millions to win the war)

Oh, another new policy! Marvellous. And, if they were all doing it, they were all genocidal criminal and Heloin's idea starts looking better and better.
And, it doesn't matter that the side committing genocide doesn't see it as genocide. It's still genocide for someone to try to wipe out millions based on their characteristics.
The Nazis didn't see it as genocide either. That argument did not hold water when they were up in court.
Comparisons between Hitler and Witch Hitler remain entirely apt.

Annie didn't go to court for her actions against the fairies though. Only for her actions against non magic users.

Genocide remains genocide, whether or not it is acknoledged in court.
We have already discovered that the justice system in this timeline is worryingly pro-mass-murdering witches.
That's why Heloin's idea looks better and better every day.

Time for a fairy uprising I think, or at the very least establishing a homeland somewhere, preferably possessing a deterrent that is the magical equivalent of nuclear weapons.
