Whether it's rape or not is not the issue as far as I care about it, but the point is that "reproductive rights" also includes "the right not to reproduce". That's why women can (in civilized societies) choose to have an abortion, if they do not want a child (if you're anti-choice, let's say she was actually violently raped by a stranger and is a minor).

Especially given the man was trying to get a divorce to begin with.

I mean, men don’t generally have that right in the West in the practical sense, except to the extent they can defend themselves, as despite rape of men being almost as common as the reverse (among adults), police look the other way and even threaten the men with charges for trying to report.

I’ve walked a number of young men through this process, and have taken to encouraging them to take a witness or lawyer with them when they go, just so there’s someone witness to the aftermath. They get better results too.

But in this particular case, we can see how this judge (and plenty of others, imo) truly think - women have rights, and men must accommodate them.
