While same-sex marriage is legal in Brazil, it is still a dangerous country for members of the LGBT community and has a large evangelical movement often critical of gay rights. According to the rights group the Grupo Gay da Bahia, 420 LGBT people were killed across Brazil in 2018, while at least 141 have been killed so far this year.

President Jair Bolsonaro, a former army captain who assumed office on January 1, has a history of offensive comments about gay people, black individuals, women and other minorities, openly acknowledging he is a homophobe. He has said he would rather have a dead son than a gay son.

The ruling "comes at a very good moment, when we have a head of state who is LGBT-phobic," said Bruna Benevides, president of the Niteroi Diversity group. "The Supreme Court assumed the responsibility to protect us."

Article 140 of the Brazillian penal code. I decided not to get excited about a change to the law without exploring what that means. Brazil has a genuinely fucked up criminal defamation statute that includes crimes against honor or dignity and without a background in brazilian law and without people spelling out what this actually means I don't know if this is affected.

There's also article 20 which outlaws practicing, inducing, or inciting discrimination or prejudice with similar penalties and sounds like it would include simple speech though I don't know how it's applied.

Also can't say just how stringent Brazilian courts are when it comes to defamation.

I couldn't say either but I'll note that defamation should generally be handled civilly and simple offense should never be a punishable offense. I don't know enough about how Brazilian law is promulgated to know what the impact of this will be. Without additional information, I'm not ready to be thoroughly jazzed.
