If the case was closed though. He must have been arrested on the American warrant. Otherwise why was he arrested? I would think whatever warrant he was arrested under would control where he goes.

On personal opinion, I think the American case is a political one, so if he were to go anywhere it should be Sweden.


He was on bail in the UK due to hearings about the stuff in Sweden. He was arrested because he broke his terms.

He was arrested on an active UK warrant from 2012 due to him skipping bail, according to the statement from the Met I posted in the OP.

I'll merely note that the Ecuadorian embassy invited the British police in.

Note to self: if I ever take refuge from a criminal charge by hiding in the embassy of a friendly government, do not anger that government's successor by embarrassing the president.

The carefully phrased agreement between the Ecuadorian and British governments rules out extraditing Assange if he would face torture or the death penalty. This is not a difficult guarantee to give given that EU members cannot extradite someone who would face the death penalty in the destination jurisdiction; but it's not quite the same as guaranteeing not to send him to a country that has the death penalty on its books.

Edit: The specific part of Moreno's statement:
I requested Great Britain to guarantee that Mr Assange would not be extradited to a country where he could face torture or the death penalty. The British government has confirmed it in writing, in accordance with its own rules


The loophole that the British Home Secretary can use, if inclined to do so, would be a guarantee from US prosecutors that they wouldn't seek the death penalty against Assange.

I stress that noting this loophole doesn't necessarily reflect my personal view on the desirability of his extradition to the US. Though I do hope he does get extradited to Sweden, mind.
