Princes, or governments, or whatever, prosecute justice, the death penalty is one of many avenues whereby justice is administered. Therefore, the death penalty is not murder.

Now, as I said, the answer was made for expediency and brevity, though I have explained a little here, and I am most aware that questions of legitimacy, justness of the laws, so on and so forth effect whether the administration of the death penalty is murder itself. However, the death penalty, in and of itself, in principle, cannot be called murder.
