Especially given that sentencing, aside from establishing the guidelines, isn't strictly 'the law,' it's judicial discression when combined with all the factors the judge is considering.

And there are numerous aggravating factors for the judge to consider.

It really is, lol. It must be something from the Eastern Seaboard colonial days because we use it here in Ohio too!

But yes, I agree with you, celebrities are just the people that should be made examples of due to the press coverage, yet they are invariably the people who escape with the lightest sentences.

I think my approach is more nuanced in the sense that they shouldn't be "made examples of" in the sense of getting more punishment for the crimes committed, as that would be unjust, but rather they should get the same sentence as the average person would for doing the same thing. But nonetheless I agree in principle.

I don't see how it would be unjust to pursue the strictest allowable punishments. The specifics of his case are far different from other such cases.

I heard on CBS Evening news that Smollett could face 64 years if he were to be convicted on all 16 counts and given 4 years max for each charge not to mention the 1-4 extra years on top of that for state charges which in total could net him anywhere 65-68 years in the slammer.

Mail fraud can land you 20 years in prison plus $250,000 in fines.
Mail fraud is serious shit.

Pretty much. Using the USPS to incite terror, a federal agency, can indeed land you in deep shit.

Nice he deserves some serious punishment for not only wasting police time but also making it harder for actual victims to come foward. Also how is that mail fraud investigation coming along?

Using the USPS to send fake ricin is like walking into an ATF building with one of those guns that shoots out a little BANG! flag. Except much worse, probably. The lengths some will go to for attention...

Actually walking into the AFT headquarters with a fake gun would more than likely just end up in fines and no jail time

I think of a good analogy and it falls flat! :p

But really, Jussie should've known that as soon as he blamed something on some MAGA cap-wearers, then they'd all start asking questions and seeing the holes in his no doubt infallible plan.

Pretty sure it would end in a grave.

WTF no >:c
You know what makes things harder for real victims? Asshats like this who cry wolf. They're the reason these cases have to be treated with scrutiny, and the more it's allowed the more real victims will be dismissed.

My mom's side of the family was from South Dakota, and the few of them I see often have used it.

I do think if found guilty, Jussie Smollett should face enough of a penalty to dissuade others from doing the same things. I'm not going to say they should lock him up and throw away the key, but IMO the white powder in the envelope stunt sounds pretty serious. From what I've heard at work, postal inspectors typically don't have a sense of humor about that shit.

Looks like they charged him once for each lie.

https://chicago.cbslocal.com/2019/03/08 ... ndictment/

The indictment expands the case against the actor. The counts focus on allegedly false statements he made to two different Chicago Police officers. Each count covers various alleged acts that Smollett falsely described to the officers–including that he was hit by two men, that they yelled racial and homophobic slurs and poured a chemical on him.

That does seem a bit suspicious and over the top to charge a person with each element of a lie in telling an overall false story. But I'm not familiar with the law in this regard.

This over the top reaction by the CPD is unsurprising. Lying about a hate crime (although there was really only a 1% chance he was lying) is not worth 16 felony charges. If he was white he would be given a little slap on the wrist in comparison.
