No but in this case its probably one of the only ways if not the only one as there is no reasonable way you could claim the 14th amendment doesnt apply to all.

No it never would even reach SCOTUS. Not ever. Appellate courts in the US only hear cases if they think the lower court messed up the procedure of the case not the specifics of the case.

As others have metioned this bill will not pass. SCOTUS has already ruled and there is no way that a strong enough case could be made to get SCOTUS to overturn it.

That’s not what needs to be argued you need to argue that the court’s decision harmed an individual.

It would still get rejected, even with a Republican SCOTUS.

A Republican SCOTUS can revoke the previous ruling, although I doubt until Roberts is replaced they will. More importantly, if the GOP had any balls, they could do an end run around the issue by limiting what SCOTUS can review; the mandate of the Court can be controlled by Congressional legislation, and the GOP could, in theory, pass legislation preventing the Court from reviewing cases of this nature. That they never have speaks volumes about their convictions on a personal level.

It's no longer 1860, where the South contains just 25% of the White population and 15% of the nation's industry. Around 50% of the oil supply in the U.S. originates in it and Alabama, for just one example, is the third largest car exporter in the Union (South Carolina is #2). Overall, 36% of the nation's population lives in the South nowadays and around 44% of its soldiers originate from these lands; we never really lost that martial ability despite the defeat.
