For someone like Annie who wiped out entire towns that would not be justice. Maybe killing her would be to extreme and that idea of handing her over to the fairy's does sound pretty good though.

the only issue with handing her over to the fairies is that without English oversight/as a co-sentencer... who knows what those evil creatures will come up with as a sentence...

My plan is simple. I would agree to send Annie back under guard of my best and most loyal men. But as she was being transported across the channel we would kill her and then sink the ship. We would then say the incident was an accident where the ship capsized but luckily everyone got but not Annie who was being kept in maximum security and thus we could not save her. This will allow us to follow international law and deliver justice to Annie.

You know what, I think there is too much of a one-sided presentation of the facts in the OP

I believe that in order to make the hypothetical more clarified and complex, I need to add a few details explaining Annie's past, motivations to even it out

but what about the damage that this causes to the authority, integrity, and precedential effectiveness of international law (even though its clearly flawed in the OP, its at least a start and the foundation is there)?

i think people are going to remember that she "died in an accident" even though the ICJ wanted something else... not that the ICJ's ruling technically stood but was unenforced

people are going to trust international law even less and when its going to be needed in the future, the infrastructure would have been damaged

give the non-humanoid "magic creatures" the vote and make them full citizens. encourage but don't require them, to elect councils of tribal elders.
also to stand for seats in parliment. neither punishment option particularly fits the crime.
but i would allow and encourage a consensus consultation of all parties involved to come up with a third and more workable option.
somewhere between the two extremes. an ordinary home, such as any peasant might happily live in, and an allowance of sufficent 'magic' to eat and stay warm,
but with neither servants nor extravigance on the one paw, nor a living hell of eternal humiliation on the other.
i'm sure there are reasonable options not requiring continuous public ridicule, even if, for all the deaths and horrors she might have caused, she might well deserve it.
but we have a pride to show the world we are better creatures then that ourselves, and not lower ourselves, to potentially self corrupting levels.
a merciful killing would not be out of the question under the circumstances.

Well seeing as these laws would have give a mass murder war criminal a slap on the wrist the ICJ losing power may not be all that much of bad thing.
