That line of reasoning always seemed off to me. Like I’m far from upset at gay marriage being legal but the logic that it being illegal is gender discrimination feels too shaky for comfort.

I think it makes some degree of sense. "Why can't I marry bob?" -> "Because you are a man, if you were a woman, you could.".

There is an out of control trolley speeding towards Jeremy Bentham, who is tied to the track. You can pull the lever to cause the trolley to switch tracks, but on the other track is Immanuel Kant. Bentham is clutching the only copy in the universe of The Critique of Pure Reason. Kant is clutching the only copy in the universe of The Principles of Moral Legislation. Both men are shouting at you that they have recently started to reconsider their ethical stances.

That sounds to me like a matter of framing that could go either way. Hence the shakiness. It’s not completely illogical, it just seems like a somewhat weak legal argument.

I can tell you that any SCOTUS that criminalized gay marriage would go down in history as the worst court since Dred Scott.

I feel like Wickard would have a pretty solid claim to that distinct honor.

It wasn’t a gender discrimination ruling, it was an equal protection ruling, which is very much valid according to the text of the 14th amendment.

I may not agree with the legal methodology used to get there, but if it gets me results…

The methodology was so cancerous that I am convinced that ninety five percent of all malign tumors in America can be traced back to this one ruling.

Four am and I’m able to get a zinger in. Almost makes me feel not angry over the stupidity of the ruling.

I mean, technically they’re not wrong. Not engaging in interstate commerce counts as affecting interstate commerce.

As a married gay man, I agree that it's a little concerning. I do understand however that law is law, and lawyers have to use any method they can to get their results.

If it weren't for the fact it's so generally accepted I might care enough to want to see specific legislation passed about it ... As it stands I'd be more worried about the riders they stuffed into that hypothetical bill than I am now about having my marriage invalidated.

My opinion on that might change if the political climate does, but as it stands even my most conservative friends consider gay marriage far at the bottom of their issues bin (and even then a surprising number of them support it)

The most serious negative consequence I've experienced was being disowned by my family at 18 years old and having to totally fend for myself, and violence in my hometown but that's behind me now (and that town has changed). I just find it hard to get worked up over such minor hypothetical issues after experiencing that.

Random story: Me and my now husband were followed home by a mob of drunks harassing us at night ( like 4-6 people) and our straight roomie got them to disperse by leaning out the window and pointing a semiauto AK at them. Love that guy to this day and will never forget their faces, because the last thing they said to him before he grabbed the rifle and they ran was "Yeah right you don't have a gun faggot"

Edit: The reason he threatened them with a gun was because they were starting to throw bottles at the side of the apartment and threatening to "Come up there"
