My understanding is that parodies and memes aren't explicitly banned. As such I've seen many defences about how "that's not what this is meant to about" or "that's not what is intended". Perhaps in every borderline case the European courts would rule in favour of "fair use" if tested. It's the fact that websites are now at risk of cases if they don't adhere to the obligation to promptly remove copyrighted material.

None of the intentions matter.

Clearly sites will not want to put themselves at risk of court cases from failing to remove material promptly enough. It's very inconvenient and you may not necessarily be awarded costs. So the natural response is to buy into detection software provided by the industry to remove the risk.

And yes, this is only Europe, but are most sites going to block out all European users to avoid this? Probably not. Rolling out the software solution universally is probably much better from a site perspective than either blocking an entire continent or maintaining separate "euro" and "non-euro" site versions where one is filtered and the other isn't.

This software will be an automated solution and thus a very blunt instrument that will catch parodies, memes etc because they will contain snippets of sufficient similarity to the original to come up as a match.

Regardless of intentions, while not "banned" in the strict sense of the word, the parody and meme community will thus find themselves substantially constrained by regular removal of material that is in fact covered by 'fair use'.
