That's the factor that I think makes this case interesting. If the person asked for an already made cake or asked them to make a random one and they said "we don't serve gays" that would be a different thing entirely.

Again, you do realize he did technically give them service? He gave them a cake and the materials to decorate it, but they wanted him to decorate it exactly how they wanted. After they refused the service he gave them, he gave the addresses of 30 other bakeries in the area. And they still refused.

This isn't illegal; he didn't simply refuse service, he refused to do something in the exact way his customers wanted. Which isn't illegal.

But federal law does does have a sorta verdict on it in the form of the first amendment. And what happened was that while he broke the law the way in which it was handled was atrocious. The CCRC did not take into account his first amendment rights
