This is clear on the lobbying side, where tech companies are going nuts against the law (1), but publishers are all in favor (2) - for obvious reasons. Social media has been taking all the advertising money for themselves, and draining publishers of revenue, while at the same time paying nothing for news they quote. The (intent) of the law is to make the social platforms pay to publishers when using their links and such.

Memes are not the target, and are likely to be ignored by any content provider under fair use provisions.

This is still in initial stages.

The measure was approved in the he European Parliament’s Legal Affairs Committee, but it will still have to:
a) Be discussed & approved in parliament
b) Approved by national governments
So far from being a done deal.


Reading some posts, i think people miss the objective of the law, which is to make Technology companies (like facebook) pay for news produced by other sources (like lets say, the Daily Telegraph).

Did they add in a section on fair use? Last I saw it was missing! I hope though I am wrong. Memes are an example of it's ridiculous nature. When the solution is borrow German music copyright enforcement methods, perhaps you should rethink the method. They too said that hate speech laws wouldn't been used on things like teenage girls posting rap lyrics, whoops. The word of the gentlemen of the EU regarding what is to be targeted while leaving a law open ended isn't worth the paper it is printed on.

Ironically enough, 'those huge media conglomerates' will be the only ones standing if Articles 11+13 pass. They'll be the only ones who can pay the 'link tax' (article 11) and smaller companies and content creators who use other's content fairly will be destroyed.

It's just like high business taxes: the big companies take a small hit, the small ones get demolished.
