If the administration really wants him they could get around the vote. IIRC if they appointed him to the position below director it doesn't require a Senate vote and he then becomes acting director so that could be a workaround if they really want him.

They let Pruitt, DeVos, and so on through. I even thought they would deny some of those, but they didn't.

Though there were also a couple they did NOT let through, though more in a way of "Rescind your nomination" and not actually having it up to a vote. But that was only a few.
