Game of Thrones is HBO. You couldn't get away with it being on ABC, CBS, NBC, etc because of FCC regulations. If the FCC can literally ban porn from broadcast television, how can you say it is protected speech?

They can though. Its not that they didn't ban it from cable - its that the FCC does not have the jurisdiction to do so. They do have jurisdiction over broadcast, and they banned porn from broadcast.

It would seem to me that the taxation of a protected right would be binary. If you can, then it applies to all, if you cannot, then it applies to all.
