Looking at the OT, it's clear monarchs can mistakenly sin. But judgement and punishment per se are not sins when performed by the sovereign, be it an individual or a state. Sovereignty is an office appointed by God to exercise these functions.
But, again, when they exercise these functions incorrectly and, as a result, inflict suffering, then that is still sin.
