Depends what you mean by Arabs. Roman accounts call people from that area Arabs, but the Arabs didn't become Muslims until the time of Mohammad and after.

Olerand wrote:I understand law. I understand power.

What I don't understand is how this relates to the fact that one can be powerful, and thus contravene the law, but not... make their actions actually legal.

A quirk of post-Enlightenment law and the novel (as far as human history goes) idea that law is somehow detached from power. That most legal systems still exist in this state is an unstable bug that will self-correct in time.

Olerand wrote:Do you recognize that fact? That the strong breaking the law and going unpunished, which Americans of all people with your judicial system should be aware of, does not actually... change the law?

In the books, no, but in practice -- in real-law -- yes.

Olerand wrote:Murdering someone and failing to be punished does not make murder legal.

Tell that to Raskolnikov.

Olerand wrote:Illegaly invading a country despite the explicit wording of the American made Charter and going unpunished does not, actually, make your invasion any more legal.

The UN Charter is anything but explicit, and if it was explicit in its prohibition of non-mandated invasions, it still would not matter because law prostrates itself before power -- yes, even in your judicially-perfect France.

Will it though? Fortunately, it hasn't yet. And it certainly hadn't in 2003. We live in the real world, and in the present. Not your future.

So... It was illegal.

Practice doesn't mean anything. There is only the law, as it exists on the books. Murder is not "in practice" legal.

I don't have to tell it to anyone. Unless if murder is legal on the books, it's not legal. The invasion wasn't legal on the books, thus it is... you guessed it, illegal.

I'm aware of power's ability to contravene the law. But again, that does not make the actions of the powerful legal. The invasion was illegal, even if America was doing it.

It wasn't a singular event, happened over time.
Indeed, a very long time, since we know of kurdish kingdoms and authorities within the area known as iraqi kurdistan going back to pre-ottoman times.
If we're going to embrace that timescale for irredentism, shouldn't you be buying a plane ticket?

So the Arabs got there how? Did the Berbers become Arab? How come they still exist distinctly then?

How did the Arabs get to Mesopotamia and Asia Minor? In which manner? On an airplane? Through invitation?

Because not all of the people there started using Arabic, but they're no longer distinct ethnically. The Arabs migrated, and the people there adopted Arabic customs and became Arabs.

So they conquered it. So why are the Kurds treacherous for conquering land while the Arabs are just?

Because they didn't slaughter? My Levantine Christian father's family begs to differ.
