That's not an origin. That's an attempt to justify them. A poor one at that.

But, suppose I accept this. Would you then agree with me if I were to say that a starving person has the natural right to steal food? It was an origin and a justification rolled into one.
As for your hypothetical, assuming that they are incapable of acquiring food though legal means, cannot forage/there isn't any food to forage for, accepts the risks of theft and will peacefully go to prison if caught, and only steals what is necessary, yes.
Although at that point they should either join a crazy rice farm or commit a petty crime and get fed in prison. Assuming this takes place in either ancient times or a modern country.

1. Denying that capitalism is directly related to the improvement in society and quality of living at a much greater pace. Because the introduction of democratic states, modern medicine, modern science were possible without the introduction of merchant classes.
