At least as far as the Convention on the Elimination of All Forms of Racial Discrimination goes, the US has made a reservation basically limiting its application to public conduct (within America's own case law, of course). I highly doubt this challenge is going to have too much teeth unless they declare the reservation itself to be against the treaty's purpose.
