A nice bit of rationalization.
I think I will forward the idea that police, military, and clandestine agents can simply evade responsibility for their actions by resigning, or at least transferring to a different service. Seems only fair.
The FBI's standard modus operandi is to not even investigate if there is no intent to prosecute, so there is singular oddity one about the affair. The truth of the matter is that Comey choked.
He realized exactly who he was pulling the trigger on, probably figured in the dismal history of Clinton opponents, and a bleak future of being tied to the whipping post by the AP for the rest of his days and beyond. With any possible hope of upward mobility evaporating in the face of that, Comey backpedaled with a typically weak legal interpretation, basically waving away the public trust with "I am sure she was just kidding. So, no harm done."

No. Treason is limited by the Constitution to "levying war against the United States... or giving their enemies aid and comfort".
He hasn't declared Trumplandia a country yet, nor has he actively tried to help Russia hack Hillary. You might be able to make the case that he gave comfort to Russia, but I doubt it.
That said, I feel they should both be in prison at this point.
