...If he's looking to get these sensitive emails disseminated to the public I dunno. This shit's a bit out of my field of expertise.

If you actually paid attention to Comey, you would have noticed that she was not indicted because, while she had been careless, there was no reliable evidence of bad faith. Therefor, there was little to no chance that an indictment would actually stick. He did say that any other State Department employee would have been punished... in terms as administrative sanctions. And since she was no longer a State Department employee herself, those could not be applied to her. You can't really punish someone the way you'd punish an employee if they resigned over three years before.

I think I will forward the idea that police, military, and clandestine agents can simply evade responsibility for their actions by resigning, or at least transferring to a different service. Seems only fair.

The FBI's standard modus operandi is to not even investigate if there is no intent to prosecute, so there is singular oddity one about the affair. The truth of the matter is that Comey choked.

He realized exactly who he was pulling the trigger on, probably figured in the dismal history of Clinton opponents, and a bleak future of being tied to the whipping post by the AP for the rest of his days and beyond. With any possible hope of upward mobility evaporating in the face of that, Comey backpedaled with a typically weak legal interpretation, basically waving away the public trust with "I am sure she was just kidding. So, no harm done."

No. Treason is limited by the Constitution to "levying war against the United States... or giving their enemies aid and comfort".

He hasn't declared Trumplandia a country yet, nor has he actively tried to help Russia hack Hillary. You might be able to make the case that he gave comfort to Russia, but I doubt it.


That said, I feel they should both be in prison at this point.

I mean I can see why he'd want Russia to release any incriminating things they have on Clinton, but if they had any they'd release them later anyway, right before the November polls. No, it was a serious statement. It wasn't to actually a call hack anything (which would be impossible, since the server with those emails is gone), but it was to release any emails if they had them. He says the same thing on his twitter.
