Congresscritters announcing a refusal to confirm a specific candidate is one thing; congresscritters refusing to confirm any candidate, however, without regard to who it might be, is another. This is the latter case.

If Obama doesn't appoint someone too far left, congress will likely confirm them.

That's not what they're announcing that they'll do.

It's what they ought to be announcing. It is perhaps even likely once the loud posturing dies down.

Justice Scalia was an American hero. We owe it to him, & the Nation, for the Senate to ensure that the next President names his replacement.

The American people‎ should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new President.

The Senate is by no means obligated to approve of any particular nominee. However, the President would be lax in his duty not to nominate a replacement; and the Senate in turn would be lax in its duty to refuse to consider any nominee a priori.

An interesting fact, Antoine Jones was both a person of color and gay, and Scalia was the 5th vote in United States v. Jones, 132 S. Ct. 945 (ruling a tracking device placed on a car was a seach).

Yeah, sorry, no. You understand we live in a technological age right? That we have detailed records of things that have happened for the last several decades.

So we know that Republicans have spent 8 years under Obama throwing a screaming tantrum complete with government shutdowns and record filibusters and embarrassing votes against their own toxic show bills and their own leadership having to filibuster their own botched political ploys all the while creating the least productive Congresses in history.a

And we know that as much as Democrats loathed Bush, and with far better reason, they still worked with him and Republicans.

So your argument is, "Yes, Republicans have been kicking and screaming and arguing that if they can't control the government then government shouldn't be allowed to function, vut years ago even though Democrats worked with us they sometimes called us mean names, so its all the same!".

Which relevant to Scalias death is exactly why Obama should nominate someone and do it soon, give Democrats ammunition coming into the election to remind their voters that Republicans are attempting to hold up a Supreme Court nomination for over a year just to once again spite Obama and because they continue on the position that if they cant have everything their way, nobody should be allowed to have anything.
