If there is a tie vote, then the lower court's decision stands, the same as if the Supreme Court had not taken up the appeal at all.

Haven't several recent decisions come down 4/5? With 8 Justices, you would have either a strong decision or a deadlock tie. This might be to some advantage.

A lot of recent ones have been 5 to 4 and yes, things could get ... interesting.

Quite possible. Bernie is the best shot the dems have. Unfortunately they have hitched their wagon to hillary, and bernie is a socialist (which still carries quite a stigma).
