Yes. But nobody that he appoints is likely to be acceptable to them. Let's not pretend this is not purely political. Obama's appointment will not be impartial but almost certainly hyper partisan.

The Senate has powers too. Both sides have every right to execise their powers.

FDR won in the end. It did seem to scare the court into submission.

And no, only a few will care. The court will stil continue to function just fine. This is purely a left right thing. Will not sway anyone.
